"A," PURSUANT TO SECTION 55-15 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED.
LOCATION: Located along the north side of NW 32 Street, and along the west side of NW 7
Avenue. [Commissioner Wifredo (Willy) Gort- District 1]
APPLICANT(S): Suzanne Dockerty, Esquire, on behalf of The Most Reverend Thomas G.
Wenski, Archbishop of the Archdiocese of Miami, and Corpus Christi Church.
PURPOSE: This will allow the applicant to close, vacate, abandon and discontinue for public
use a portion of a public road.
FINDING(S):
PLANNING AND ZONING DEPARTMENT: Recommended approval with conditions
PLAT & STREET COMMITTEE: Recommended approval on April 17, 2016 by a vote of 6-0
Planning, Zoning and Appeals Board: Recommended approval, with conditions, on May 3,
2017, by a vote of 10-0.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING, WITH CONDITIONS, THE CLOSING, VACATING, ABANDONING, AND
DISCONTINUING FOR PUBLIC USE A PORTION OF NORTHWEST 7 COURT,
LOCATED ALONG THE NORTH SIDE OF NORTHWEST 32 STREET AND ALONG
THE WEST SIDE OF NORTHWEST 7 AVENUE, MIAMI, FLORIDA, AS DEPICTED IN
EXHIBIT "A," PURSUANT TO SECTION 55-15 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED.
WHEREAS, the Plat and Street Committee ("PSC"), at its meeting on April 7, 2016,
reviewed the street closure application for a portion of Northwest 7 Court, located along the
north side of Northwest 32 Street and along the west side of Northwest 7 Avenue, Miami,
Florida, as depicted in Exhibit "A" ("Public Right -of -Way"), and determined that all technical
requirements have been met and by a vote of six to zero (6-0), recommended approval of the
vacation and closure as set forth; and
WHEREAS, the Department of Public Works ("Public Works") and the Plat and Street
Committee have reviewed the subject vacation and closure and determined that it will not affect
pedestrian or vehicular traffic circulation, or access for public service; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting held on
May 3, 2017, following an advertised public hearing, reviewed the street closure application and
adopted Resolution No. PZAB-R-17-030 by a vote of ten to zero (10-0) recommending approval
with conditions of the vacation and closure; and
WHEREAS, based on the testimony and evidence presented, after due notice and an
opportunity to be heard has been afforded to all parties and members of the public, there is
substantial evidence in the record to recommend approval of the closure, vacating, abandoning,
and discontinuing for public use a portion of the Public Right -of -Way and deems it advisable to
do so;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI CITY COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. A portion of the Public Right -of -Way is hereby closed, vacated, abandoned
and discontinued for public use.
Section 3. The conditions of the closure, vacation, abandonment, and discontinuance
for public use of a portion of the Public Right -of -Way, as recommended by the PZAB and
adopted by the City Commission, are that 1) the applicant or its successor shall comply with the
conditions of approval stated for the Corpus Christi Tentative Plat No. 1862-A, in a letter dated
April 15, 2016 issued by Public Works, and 2) the applicant, or its successor, shall comply with
all development standards identified in the Miami 21 Code, the Zoning Ordinance of the City of
Miami, Florida, as amended, and all applicable local, state and federal regulations.
Section 4. Approval of the requested closure, vacating, abandoning and discontinuing
for public use of a portion of the Public Right -of -Way shall be valid for a period of four (4) years
and shall remain independent of the referenced tentative plat during this period.
Section 5. The approved final plat must be recorded within the four (4) year approval
period of the requested vacation and closure.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
