The nature of this item is to seek City Commission authorization to increase the annual
contract capacity for the Citywide Sidewalk Improvements Contract M-0096 from an
amount not to exceed $1,487,500, to an amount not to exceed $1,587,500, allocating
funds from the various sources of funds, subject to the availability of funds and
budgetary approval at time of need, and to grant authorization to the City Manager to
execute any other documents, modifications, and amendments to the contract, in a form
acceptable to the City Attorney, as may be necessary for said purpose.
Background of Item:
On September 12, 2013, the City Commission adopted Resolution 13-0341 for a
Citywide Sidewalk Improvement Contract No. M-0096. This resolution included a not to
exceed annual amount of $1,487,500. The Parks and Recreation Department ("Parks")
has a need to utilize this contract; therefore, an increase in annual capacity by $100,000
is being requested to cover the needs of Parks.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN INCREASE
IN THE ANNUAL CONTRACT CAPACITY FOR CITYWIDE SIDEWALK
IMPROVEMENT CONTRACT M-0096 IN THE AMOUNT OF $100,000.00, THEREBY
INCREASING THE CONTRACT CAPACITY FROM AN AMOUNT NOT TO EXCEED
$1,487,500.00 TO AN AMOUNT NOT TO EXCEED $1,587,500.00; ALLOCATING
FUNDS FROM THE VARIOUS SOURCES OF FUNDS, SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT TIME OF NEED;
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER DOCUMENTS,
MODIFICATIONS, AND AMENDMENTS TO THE CONTRACT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID
PURPOSE.
WHEREAS, on September 12, 2013, the City Commission adopted Resolution No. 13-
0341 for Citywide Sidewalk Improvement Contract No. M-0096, which authorized a not to
exceed annual amount of $1,487,500.00; and
WHEREAS, the Parks and Recreation Department ("Parks") has a need to utilize this
contract for the improvement of walkways and sidewalks in City parks, and therefore, an
increase in annual capacity by $100,000.00 is being requested to cover these needs; and
WHEREAS, an increase in the annual contract capacity for Citywide Sidewalk
Improvement Contract M-0096 from an amount not to exceed $1,487,500.00 to an amount not
to exceed $1,587,500.00 is requested to accommodate the above referenced need with funds
allocated from the various sources of funds, subject to the availability of funds and budgetary
approval at time of need;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. An increase in the annual contract capacity for Citywide Sidewalk
Improvement Contract M-0096 in the amount of $100,000.00, thereby increasing the contract
capacity from an amount not to exceed $1,487,500.00 to an amount not to exceed
$1,587,500.00, is approved.
Section 3. Allocating funds from the various sources of funds, subject to the availability
of funds and budgetary approval at time of need.
Section 4. The City Manager is authorized' to negotiate and execute all other
documents, modifications, and amendments to the Contract, in a form acceptable to the City
Attorney, as may be necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
