City Clerk A RESOLUTION OF THE COMMERCIAL SOLID WASTE MANAGEMENT ADVISORY COMMITTEE URGING THE MIAMI CITY COMMISSION ("COMMISSION") AND CITY MANAGER ("MANAGER") TO UPHOLD AND ENFORCE CHAPTER 22, ARTICLE II, OF THE CODE OF THE CITY OF MIAMI, FLORIDA ("CITY CODE") ENTITLED "REGULATION OF PERSONS ENGAGED IN COMMERCIAL WASTE COLLECTION", URGING THE DEPARTMENT OF SOLID WASTE ("DEPARTMENT") TO ENFORCE CHAPTER 22 OF THE CITY CODE; URGING THE MANAGER TO DIRECT THE DEPARTMENT TO PROVIDE AN IMMEDIATE CEASE AND DESIST NOTICE TO ANY ENTITIES ENGAGED 1N THE BUSINESS OF COMMERCIAL SOLID WASTE HAULING SERVICES WITHIN THE CITY OF MIAMI ("CITY") WITHOUT THE REQUIRED NON-EXCLUSIVE COMMERCIAL SOLID WASTE FRANCHISE AND NECESSARY PERMITS; FURTHER RECOMMENDING THE MANAGER'S INCLUSION OF ONE (1) ADDITIONAL COMMERCIAL SOLID WASTE HAULER TO THE CITY'S COMMERCIAL SOLID WASTE HAULING SERVICES REQUEST FOR QUALIFICATIONS ("RFQ") CONTRACT NO. 495344 SUBJECT TO SUCCESSFUL QUALIFICATION FOR A CITY FRANCHISE. WHEREAS, on May 4, 2016, the Solid Waste Management Advisory Committee ("Committee") met and discussed the new City of Miami ("City") Commercial Solid Waste Hauling Services Request for Qualifications ("RFQ") Contract No. 495344, as approved by City Commission Resolution No, 15-0499, enacted November 19, 2015; and WHEREAS, the Committee also discussed Bicon, Inc., doing business as S & S National Waste ("S & S"), a commercial solid waste hauler with a franchise under currently expired City Commercial Solid Waste Hauling Services RFQ Contract No. 222246, S & S's apparent provision of commercial solid waste hauling services within the City absent a current franchise and permits issued pursuant to the same, and S & S's desire to maintain a franchise with inclusion under the City's new contract for said services; NOW, THEREFORE, BE IT RESOLVED BY THE SOLID WASTE MANAGEMENT ADVISORY COMMITTEE OF THE CITY OF IVIIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Committee urges the Miami City Commission ("Commission") and City Manager ("Manager") to uphold and enforce Chapter 22, Article II of the Code of the City of Miami, Florida ("City Code"), entitled "Regulation of Persons Engaged in Commercial Waste Collection". Section 3, The Committee further urges the Department of Solid Waste ("Department") to enforce Chapter 22 of the City Code. Section 4. The Committee urges that the Manager direct the Department to provide an immediate cease and desist notice to any entities engaged in the business of commercial solid waste hauling services within the City of Miami ("City") without the required Non -Exclusive Commercial Solid Waste Franchise and necessary permits. 16-00940-Submittal-Chair Hardemon-Resolution of the Commercial Solid Waste Management Advisory Committee Submitted into the public record for item(s) NA.4 . on June 23, 2016. The Committee recommends the Manager include one (1) additional commercial solid waste hauler to the City's Commercial Solid Waste Hauling Services RFQ Contract No. 495344 subject to successful qualification for a City franchise. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Committee Chairperson. PASSED AND ADOPTED this 4th day of May, 2016.
