HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00238 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE PERMIT FEES FOR THE USE OF PORTABLE STAGES AND THE PERMIT FEES FOR THE USE OF DEPARTMENT OF PARKS AND RECREATION FACILITIES PURSUANT TO SECTION 38-74(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "SAME - ACTIVITIES FOR WHICH A PERMIT IS REQUIRED", FOR THE MIAMI TASTE OF BRICKELL FOOD AND WINE FESTIVAL TO BE HELD FROM MARCH 18, 2016 THROUGH MARCH 19, 2016 AT BRICKELL PARK. WHEREAS, the Miami Taste of Brickell Food and Wine Festival, now in its fifth (5th) year, is a cultural event of Citywide renown that provides economic and leisure opportunities to City of Miami ("City") residents; and WHEREAS, the Miami Taste of Brickell Food and Wine Festival's stated goal is to promote the City's urban core as a visitor's destination for fine dining, shopping and entertainment, a laudable goal this Commission wishes to promote; and WHEREAS, the Miami Taste of Brickell Food and Wine Festival desires to use a portion of Brickell Park to hold an exhibition open to the public, which will include entertainment for children and families; and WHEREAS, the Miami Taste of Brickell Food and Wine Festival additionally desires to use City resources in the form of a mobile stage managed by the Department of Parks and Recreation ("Department"); and WHEREAS, the Miami Taste of Brickell Food and Wine Festival and its organizers have been honored in the past by the Miami -Dade Board of County Commissioners for "highlighting the cultural cuisines in our midst"; and WHEREAS, the City plans to cosponsor the Miami Taste of Brickell Food and Wine Festival and therefore waiver of the associated permit fees is allowed pursuant to Section 54-3(e) of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, Section 38-74(a) of the City Code requires a permit for this type of activity and waiving the associated permit fees to allow the Miami Taste of Brickell Food and Wine Festival to use a City park and City resources will result in a negligible financial impact to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. The permit fees for the use of portable stages and the permit fees for the use of Department facilities pursuant to Section 38-74(a) of the City Code entitled "Same - activities for which a permit is required", for the Miami Taste of Brickell Food and Wine Festival to be held from March 18, 2016 through March 19, 2016 at Brickell Park are waived. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
