HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01600 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AND SALE AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND DAVID ROSENTHAL AND MARVIN ROSENTHAL ("SELLERS"), FOR THE ACQUISITION OF THE REAL PROPERTY LOCATED AT 2000 SOUTHWEST 33RD AVENUE, MIAMI, FLORIDA, ("PROPERTY"), WITH AN APPROXIMATE TOTAL LOT AREA OF 6,363 SQUARE FEET, AS LEGALLY DESCRIBED IN THE AGREEMENT, FORA TOTAL PURCHASE PRICE OF FOUR HUNDRED FORTY NINE THOUSAND NINE HUNDRED NINETY NINE DOLLARS ($449,999.00), CONTINGENT UPON THE CITY OBTAINING A WRITTEN APPRAISAL FROM A LICENSED FLORIDAAPPRAISER STATING THAT THE APPRAISED VALUE OF THE PROPERTY IS AT MINIMUM THE REFERENCED AMOUNT HEREIN; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO EFFECTUATE SAID ACQUISITION; WITH FUNDS ALLOCATED FROM THE CAPITAL IMPROVEMENT AND TRANSPORTATION PROGRAM PROJECT B-50568, DISTRICT 4 PARK LAND ACQUISITION, IN THE TOTAL AMOUNT NOT TO EXCEED FOUR HUNDRED SIXTY THOUSAND DOLLARS ($460,000.00), TO COVER THE COST OF SAID ACQUISITION, INCLUSIVE OF THE COST OF THE SURVEY, ENVIRONMENTAL REPORT, TITLE INSURANCE AND SUCH OTHER RELATED CLOSING COSTS ASSOCIATED WITH SAID ACQUISITION, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE AGREEMENT. WHEREAS, the City of Miami ("City") wishes to acquire the privately -owned property located at 2000 Southwest 33rd Avenue, Miami, Florida ("Property") with an approximate total lot area of 6,363 square feet, as legally described in the Purchase and Sale Agreement ("Agreement"), attached and incorporated as Exhibit "A"; and WHEREAS, the City plans to construct a park at the Property to enhance the quality of life of the residents of the City; and WHEREAS, David Rosenthal and Marvin Rosenthal ("Sellers") agree to enter into the Agreement to sell the Property to the City for Four Hundred Forty Nine Thousand Nine Hundred Ninety Nine Dollars ($449,999.00); and WHEREAS, the Agreement is contingent upon the City obtaining a written appraisal from a licensed Florida appraiser stating that the appraised value is at a minimum the referenced amount of Four Hundred Forty Nine Thousand Nine Hundred Ninety Nine Dollars ($449,999.00); and WHEREAS, the City's estimated total cost for the acquisition of the Property will not exceed Four City of Miami Page 1 of 2 File Id: 15-01600 (Version: 11 Printed On: 9/3/2024 File Number: 15-01600 Hundred Sixty Thousand Dollars ($460,000.00), to be allocated from Capital Improvement and Transportation Program ("CITP") Project No. B-50568, District 4 Park Land Acquisition; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement in substantially the attached form, between the City and the Sellers, for the acquisition of the real property located at 2000 Southwest 33rd Avenue, Miami, Florida ("Property"), with an approximate total lot area of 6,363 square feet, as legally described in the Agreement, for a total purchase price of Four Hundred Forty Nine Thousand Nine Hundred Ninety Nine Dollars ($449,999.00), contingent upon the City obtaining a written appraisal from a licensed Florida appraiser stating that the appraised value of the property is at a minimum the referenced amount herein. Section 3. The City Manager is further authorized to negotiate and execute all other documents, including amendments and modifications to said Agreement, in a form acceptable to the City Attorney, as may be necessary to effectuate said acquisition, with funds allocated from the CITP Project No. B-50568, District 4 Park Land Acquisition, in the total amount not to exceed Four Hundred Sixty Thousand Dollars ($460,000.00), to cover the cost of said acquisition, inclusive of the cost of the survey, environmental report, title insurance and such other related closing costs associated with said acquisition, in accordance with the terms and conditions of the Agreement. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
