HomeMy WebLinkAboutLegislation FR (v2) 01-14-16City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01398 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 29/ARTICLE IV, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "LANDFILLS AND WATERFRONT IMPROVEMENTS/WATERFRONT ADVISORY BOARD", MORE PARTICULARLY BY AMENDING SECTION 29-124, TO AMEND THE WATERFRONT ADVISORY BOARD'S QUORUM REQUIREMENT; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 29, Article IV of the Code of the City of Miami, Florida, as amended ("City Code"), provides for the Waterfront Advisory Board ("Board") to be tasked with reviewing waterfront development in the City of Miami ("City") and making recommendations to the City Commission; and WHEREAS, the Board, with a current quorum requirement of six (6) members, has had difficulty meeting this requirement each meeting; and WHEREAS, absent a quorum, the Board may only discuss, but cannot issue recommendations or approve minutes; and WHEREAS, the City Commission desires to amend the Board's quorum requirement to facilitate the Board's mission to make recommendations as to the City's waterfront; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 29/Article IV of the City Code, is amended in the following particulars:{1 } "CHAPTER 29 LANDFILLS AND WATERFRONT IMPROVEMENTS ARTICLE IV. WATERFRONT ADVISORY BOARD * Ye Sec. 29-123. - Composition; terms; appointment; removal. (a) The board shall consist of 12 members, composed as follows: (1) Two members appointed by the mayor. (2) Ten members appointed by the city commission, with each commissioner nominating two City ofMianri Page 1 of 3 File Id: 15-01398 (Version: 2) Printed On: 12/18/2015 File Number: 15-01398 individuals; and (b) All members shall serve without compensation for terms of office of one year or until the nominating commissioner leaves office, whichever occurs first, and shall be subject to removal by the commission for any cause, A member's absence from four of the cumulative meetings within any one calendar year period or from three consecutive meetings of the board within a calendar year shall result in the member's removal from the board upon the chairperson's filing of a certificate of such absences with the city clerk. Any member absent from four (4) of the cumulative meetings within any one (1) calendar year period or from three (3) consecutive meetings of the Board within a calendar year shall no longer be considered a member in good standing. Any vacancy occurring during such term shall be filled for the remainder of the term in the same manner as the original appointment, (c) Members shall reside in the city or maintain a place of business or office in the city or own real property in the city at the time of their appointment. Sec. 29-124. - Officers; meetings; quorum; reports; support. (a) The board shall select one of its members as chairperson. No chairperson shall serve more than three years in that office. A vice -chairperson may also be designated by the board from among its members to serve as chairperson at any meeting if the chairperson is absent from the meeting. (b) A quorum shall consist of six (6) members..- or a majority of the current number of members in good standing pursuant to Section 29-123, as amended. A decision of the board shall be made only upon an affirmative vote of the majority of those members in attendance. For instances of a tie vote, the outcome of the vote shall be determined by th,e vote of the chairperson. Section 3. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
