A RESOLUTION OF THE MIAMI CITY commissIoN, VIIITHATTAOHMENT(8),
CLOSING, VACATING, ABANDONING, AND DISCONTINUING FOR 'PUBLIC US A
PORTION OP NORTHEAST $1 ST STREET, LYING EAST OF NORTHEAST 7TH
AVENUEAND WEST OF BISCAYNE BAY; AND A PORTION OF NORTHEAST 31ST
STREET, LYING 280 FEET WEST OF NORTHEAST 7TH AVENUE, AND 490 FEET
tAiEST OF NORTHEAST 7TH AVENUE, MIAMI, FLORIDA.
WHEREAS, the Plat and Street Committee (Otte'), at Its meeting on October 2, 2014, has
reviewed the subject tentative plat entitled '`.11.ANA," and deterinitted that all technical requirements
have been met, and by a veto of six to zero (8 - 0) recommended approval subjett te conditions of the
vacation and closure as set forth! and
WHEREAS, the City of Miami ("City") Department of Public Works and the Committee hove
studied the subject vacation and closure, and determined that it will not affect pedestrian or vehicular
trafflo circulation or atoess for public service; and
WHEFIVAS, the Mam1 Planning, Zoning and Appeals Board C`PZAB",), at Its meeting on December
17, 2014, f011ewing an advertised public hearing, adopted Resolution No. PZAB-R-14-077 by a vote of
eight to zero (8-0), item FZAB.7, recommending APPROVAL, with onditions as stated In the staff
analysis and with the covenant preferred by the applicant, of the Vacation and closure aS set forth; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and
In the best Interest of the enraral welfare of the City and Its Inhabitants, to grantthe vocation and
closure of a portion of the public righW-way es hereinafter described, and deems it advisable to do
SD;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMSOW OF THE erry OF MIAMI,
FLORIDA!
Section 1, The recitals and findings contained in the Preamble to this Resolution are adopted by
reference end incorporated ea fully set forth in this Section.
Section 2. Approximately a portion of Northeast 31st Street, lying East of Northeast 7th Avenue
and West of Biscayne Bay:, and a portion of Northeast 31st Street, lying 280 feet VVest of Northeast
7th Avenue and 400 feet West of Northeast 7th Avenue, Miami, Florida, more pertiouterlY described In
Exhibit "A" is closed, vacated, abandoned, and discontinued for public! use,
Section S. The City Commission accepts the cOverMit_profermd by thelipplicant included in the
record,TThe applicant shall reoord the covenant and furnish a certifled copy of the recorded covenant
to both the Director of the Oity's Planning and Zoning Department and Porto and Recreation
Department,

CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE A
PORTION or NORTHEAST 31sT STREET FROM NORTHEAST 7TH AVENUE TO
APPROXIMATELY 280 FEET WEST OF NORTHEAST Ti'H AVENUE, IVIIAM1,
FLORIDA.
WHEREAS, the Plat and Street Committee, at its meeting on October 3, 2013, has reviewed the
subject tentative plat entitled, "Ilana" and determined that all technical requirements have been met
and by a vote of six to zero (6-0) recommending APPROVAL of the vacation and closure subject to: a)
The applicant shall execute a covenant to run with the land to maintain the proposed Tract A located
west of the proposed Northeast eth Avenue roadway alignment; b) The applicant shall execute en
agreement to run with the land to maintain the proposed park located in Tract; and c) A platted
development restriction to comply with the requirements of the Miami 21 Zoning Code concerning the
Northeast 31st Street view corridor; and
WHEREAS, the Department of Public Works and the Plat and Street Committee have studied the
subject vacatIon.and closure and determined that It will not affect pedestrian or vehicular traffic
circulation or access for public service; and
WHEREAS, the Miami Planning, Zoning and Appeals Board ("PZAB"), at its meeting on December
11, 201a, following an advertised public hearing, adopted Resolution No. PZAB-R-13-061 by e Vote of
seven to one (7-1), item no, 1 , recommending APPROVAL of the vacation and closure as set forth;
and
WHEREAS, the City Commission, finds that It Is in the best Interest of the general welfare of the
City of Miami and its inhabitants to grant the vacation end closure of a portion of the public right-of-way
as hereinafter described, and deems It advisable to do so;
NOW, THEREFORE, BE IT RESOLVED E3Y THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

reference and Incorporated as If fully set forth In thls Section,
Section 2. The portion of Northeast 31st Street, from Northeast 7th Avenue to approximately 280
feet west of Northeast 7th Avenue, Miami, Florida, more particularly described In Exhibit "A," is closed,
vacated, abandoned and discontinued for publio use,
Section 8. Approval of the requested vacation and closure shall be valid for a period of four (4)
years -end shalt remain Independent -of the -referenced tentative plat during this period,
Section 4. The approved final plot must he recorded within the four (4) year approval period of the
requested vacation and closure
