A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND
CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING THAT IT IS MOST
ADVANTAGEOUS FOR THE CITY OF MIAMI TO WAIVE THE COMPETITIVE
SEALED BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; FURTHER APPROVING THE
RETROACTIVE SELECTION OF TRANE US, INC. FOR THE CHILLER PLANT
UPGRADE PROJECT AT THE CITY OF MIAMI POLICE DEPARTMENT
HEADQUARTER BUILDING, FORATOTALAMOUNT NOT TO EXCEED
$469,386.00,
WHEREAS, the Miami Police Department ("MPD") has found it operationally necessary to
procure the chiller plant upgrade project for the MPD Headquarter Building located at 400 Northwest
2nd Avenue, Miami, Florida to prevent future costly repairs to the existing chillers and operating
systems, which are more than twenty (20) years old, obsolete, and in very poor condition; and
WHEREAS, the chiller plant upgrade project is vital to the ongoing police operations and the
health and safety of the employees and visitors who frequent the MPD Headquarter Building; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami,
Florida, as amended ("City Code"), approved an emergency bid waiver for the procurement of the
chiller plant upgrade project for a total amount not to exceed $469,386.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's emergency finding that it
is most advantageous for the City of Miami to waive the competitive sealed bidding procedures,
pursuant to Section 18-90 of the City Code, is ratified, approved, and confirmed, and the retroactive
selection of Trane US, Inc. for the chiller plant upgrade project at the MPD Headquarter Building, for a
total amount not to exceed $469,386.00, is approved.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
