Alfonso City Manager Annie Perez, CPPO Director, Procurement Charles Johnson, III Sr. Procurement Cantracting Officer DATE : July 28, 2016 FILE : SUBJECT: Sole Source: PVP Communications Wireless Motorcycle Helmet Communications Kits with Related REFERENCES : Equipment ENCLOSURES: An investigation was conducted to determine whether Shannon Dieringer d/b/a Blue Line Communications, a Non -Local vendor, located at 701 Blue Bird Lane, Plantation, FL, is the sole source provider for acquisition of PVP Communications Wireless Motorcycle Helmet Communication Kits and Related Equipment ("Kits"). The feature requested by the Police Department is technology protected by US Patent No. 5,790,947. This patent is registered to Michael Dieringer, the founder and. President of PVP Communications, Inc. ("PVP"). PVP is the exclusive manufacturer of the Kits. Shannon Dieringer d/b/a Blue Line Communications ("Blue Line"), is the sole supplier of the Kits for the region to include the State of Florida. In addition, it was learned that police departments throughout the State have purchased these kits as a sole source from Blue Line. PVP's "Autoswitching" feature wirelessly connects the Officer's helmet headset to the motorcycle radio when the Officer is on his motorcycle and automatically switches to his / her portable radio upon dismount. The manufacturer, PVP provided a letter stating that the kits are sole source, making use of technology protected by the Patent listed above. PVP is based in Torrance, California. Accordingly, pursuant to Section 18-92 (a) (1) of the Code of the City of Miami, it is recommended that the requirements for competitive bidding be waived, and these findings be approved: Shannon Dieringer d/b/a Blue Line Communications, is the sole source distributor of PVP Communications Wireless Helmet Communication Kits, and approving the purchase of the PVP Communications Wireless Helmet Communication Kits from Shannon Dieringer d/b/a Blue Line Communications for the Police Department, in an amount of $38,639.25: allocating funds from the Law Enforcement Trust Fund, Account Code No. 12500.191602.552000, Project No. 19-690002, Award No. 1019 and Task No. 07.18.
