HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-01175 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF TWENTY-FIVE (25) PVP COMMUNICATIONS WIRELESS MOTORCYCLE HELMET COMMUNICATION KITS WITH RELATED EQUIPMENT FROM SHANNON GEORGIA DIERINGER D/B/A BLUE LINE COMMUNICATIONS, FOR THE DEPARTMENT OF POLICE, ON AN AS -NEEDED CONTRACTUAL BASIS FOR A PERIOD OF ONE (1) YEAR, RENEWABLE ANNUALLY, SUBJECT TO AN ANNUAL FINDING OF SOLE SOURCE BY THE CHIEF PROCUREMENT OFFICER AND APPROVED BY THE CITY MANAGER, FOR AN INITIAL PURCHASE PRICE OF $38,639,25; ALLOCATING FUNDS FROM THE LAW ENFORCEMENT TRUST FUND ACCOUNT CODE NO. 12500.191602.55200, PROJECT NO, 19-690002, AWARD NO. 1019 AND TASK NO. 07.18; WITH FUTURE PURCHASES TO BE ALLOCATED FROM THE VARIOUS SOURCES OF FUNDS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, the Miami Police Department ("MPD") requires viable resources to equip its officers to better protect and serve the City of Miami ("City"); and WHEREAS, PVP Communications, Inc, is the sole manufacturer of the PVP Communications Wireless Motorcycle Helmet Communication Kits and Related Equipment ("Kits"); and WHEREAS, Shannon Georgia Dieringer d/b/a Blue Line Communications is the sole area distributor of the Kits; and WHEREAS, the Kits enable wireless communication through the Motorcycle Officer's personal radio and Public Address system while keeping both hands on the motorcycle handlebars, greatly increasing Officer safety; and WHEREAS, the Kits allow for automatic switching between an Officer's trunk -mounted radio and personal radio using patented technology; and WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that Shannon Georgia Dieringer d/b/a Blue Line Communications, is the sole source provider of the Kits, a safety and efficiency solution for motorcycle -based law enforcement; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and City of Miami Page 1 of 2 File Id: 16-01175 (Version: 1) Printed On: 8/17/2016 File Number: 16-01175 WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and that the procurement of the Kits, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the procurement of twenty-five (25) Kits from Shannon Georgia Dieringer d/b/a Blue Line Communications, for the MPD, on an as -needed contractual basis for a period of one (1) year, renewable annually, subject to an annual finding of sole source by the Chief Procurement Officer and approved by the City Manager, for an initial purchase price of $38,639.25, is approved. Section 3. Funds to be allocated from the Law Enforcement Trust Fund Account Code No. 12500.191602.55200, Project No. 19-690002, Award No. 1019 and Task No. 07.18, with future purchases to be allocated from the various sources of funds, subject to the availability of funds and budgetary approval at the time of need. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } APPR O VI QZ'T VED AS TO FORM AND CORRECTNESS: RIA ENDEZ CITY ATTORNEY Footnotes: {1} This resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
