My husband & I and many other people choose to live in Coconut Grove because of the
beautiful trees. Without the tree canopy, Miami would be Not be habitable for us & many
others. The canopy protects our skins & eyes from excessive light and heat exposure. Many
visitors to Miami also seek out The Grove, It is a beautiful place, mainly because of its lush
foliage which cannot exist without the pervasive Tree Canopy. If Canopy goes, Desert Results,
The Miami 2.1 code, Appendix A: Neighborhood Conservation District, is an excellent code. It
takes into consideration the nature of humans who might like to actually Live Here, not just
those thinking they will make a quick profit here on huge houses crowded onto tiny lots, for
example, investors seeking "on-line" FLIP deals, ultimately leaving locals to cope with negative
impacts.
The NCD Neighborhood Conservation District Code is fairly concise, maybe 10 pages. The
section pertaining to the Single -Family Residential District is section 3.6 and starts on page
A.17.
The opening 2 paragraphs clarify the INTENT of the law, they read as follows:
"The single family residential district is INTENDED to protect the low density residential and
dominant tree canopy characteristics of Coconut Grove and prevent the INTRUSION of
ADDITIONAL DENSITY, USES and HEIGHT..
All T3, Single -Family Residential zoning REGULATIONS SHALL APPLY within the Coconut Grove
NCD-3 Single -Family Residential District, hereafter referred to as NCD-3, except as modified
below. If any such requirements CONFLICT, NCD-3 requirements SHALL APPLY. "
Not only do these 3 sentences spell out the INTENT of this code, they also specify what is to be
done when requirements CONFLICT. "If any such requirements conflict, NCD-3
REQUIREMENTS SHALL APPLY."
It is the hope of many people, those here today as well as many others who love Miami, that
the conflicts which have been so evident and have brought us here so often, can be put to rest
by your votes today to ENFORCE THE INTENT OF THE CODE, pis DENY this motion before you.

3.5 Coconut Grove Corridors

The sub -districts are demarcated, traversed or connected by important corridors subject to their own
unique characteristics and considerations. The Coconut Grove corridors are as follows and include the
rights of way and the Lots immediately adjacent to the right of way:
• South Bayshore Drive
• Tigertail Drive
• S.W. 27th Avenue
• Bird Avenue
• MacDonald Street
• Main Highway
• Douglas Road
• Grand Avenue
• Le Jeune Road
a. Improvements and new development on these corridors shall conform to the following pedestrian
safety and comfort standards:
1. Where sidewalks exist, the pedestrian shall be buffered from vehicular traffic with streetscape
elements and landscaping.
2. Uses to be developed on these corridors shall promote pedestrian activity, such as porches,
loggias, windows, entries, plazas, and ground floor retail uses where permissible.
3. The number and dimensions of curb cuts and driveways shall be minimized to reduce the
pedestrian/vehicular conflicts up to the minimum permissible by the controlling jurisdiction.
3.6 Single -Family Residential District
The single family residential district is intended to protect the low density residential and dominant tree
canopy characteristics of Coconut Grove and prevent the intrusion of additional density, uses, and height.
All T3, Single -Family Residential zoning regulations shall apply within the Coconut Grove NCD-3 Sin-
gle -Family- Residential District, hereafter referred to as NCD-3, except as modified below. if any such
requirements conflict, NCD-3 requirements shall apply.
a. Adjacent lots or lots in the same subdivision under single ownership, or developed by a single
builder or developer shall not employ the same, similar or duplicate architectural plans. Adjacent
buildings under such conditions shall be substantially differentiated in massing, footprint, and
exterior detailing.
b. Front yards
All front yards in the NCD-3 shall be designed in a way that minimizes the impact of garage fronts
and off-street parking. Front yards shall provide a more permeable surface and use abundant
landscaping and tree canopy throughout.
c. Building Envelope
For the purpose of this section, a building site shall be defined as one or more lots or portions
of Tots that are aggregated to form a single family residential site including vacant lots and all

Please find attached 20 additional signatures on petitions from many of our neighbors in Coconut Grove. With
the 197 submitted at the last hearing that brings the total to 217 signers. We share a concern for the pattern of
over -development which is taking place in our community. Single-family building sites are becoming
subdivisions in our midst, comprised of multiple over -sized houses crammed onto tightly spaced lots where
canopy trees will never be able to grow again. This formula is crowding out canopy trees as well as the dense
tropical foliage for which Coconut Grove is known.... This errant development is taking place via a systematic
effort to circumvent the protective Neighborhood Conservation District Zoning contained in Miami-21, and
perhaps the corruption of City employees. The single family residential district is intended to protect the low
density residential and dominant tree canopy characteristics of Coconut Grove and prevent the intrusion of
additional density.
The city plan lists 10 objectives which address environment& and development interests. This subdivision
Battersea Woods, advances none of those interests and in fact works counter to 9 out of the 10. If The city of
Miami is to advance its' plan to promote growth in the central core and in areas conducive to walkability, cycling
and mass transit. While it limits development contributing to unwanted increases in density, congestion, and
degradation of infrastructure the commission must interpret the code in accordance with its' intent. Residents
cherish and seek to preserve this lovely environment & community while we attempt to hang on to what
vestiges of the vanishing "Grove" remain. They simply want to be able to enjoy their lives in this historic
community they work hard to be able to reside in, without having to continually visit city hall.
We ask that the commission assist us in stopping this destruction of the nature and character of our
neighborhood by simply enforcing the letter and intent of the Miami-21 zoning code and in particular the tenets
of Appendix A3. It is a model code, well thought out and written; it reflects what our time honored leaders
considered to be in the community's best interests. if we do not protect our Neighborhood Conservation
Districts it will ultimately lead to the demise of established communities and may even "kill the goose that laid
the golden egg."
We respectfully request that this re -plat be denied.

older Western Hemisphere cities it is not uncommon to preserve older communities; that is what the
neighborhood conservation district (NCD) is intended to achieve..
Many subdivisions: 4384 Ingraham Hwy, 4200 Grove St , and 3737 Justison, are completely against
the spirit and the letter of the current zoning code: Miami-21, A-3 which spells out our NCD zoning
laws. Many other properties: 3790 Loquat, 3640 Avocado, 4039 Ventura, and 3850 Plaza have
been illegally subdivided thereby diminishing properties in existence when the NCD went into
effect; multiple building permits have been issued in violation of the code.
In Light of this pattern, We object to the issuance of multiple building permits for any lot(s)
which were single building sites in accordance with NCD-3, and no more than 2 building permits
for any duplex site in any NCD, Management controls need to be implemented to ensure that
re -platting, or recognition of additional folio numbers for any single building site as defined by
the code above may only be done by warrant. Violations need to be stopped, remedied &
reversed to preserve the precious nature and character of Miami's oldest neighborhood.
