Letter of Intent
Dear Mr, Garcia,
Holland & Knight LLP represents, collectively, as co -applicants, the owners of the
properties located at 30 NW 34 St., 62 NW 34 St., 48 NW 34 St. and 54 NW 34 St. in
connection with the land use and zoning change from "Duplex Residential" to "Low Density
Restricted Commercial" and from "T3-O" to "T4-O".
This request meets the criteria for Amendments to the Miami 21 Zoning maps.
Specifically, "no rezoning of land shall be considered which involves less than forty thousand
(40,000) square feet of land area or two hundred (200) feet of street Frontage on one (1) street."
The subject lands involve 300 linear feet of frontage along NW 34 Street,
Existing Conditions
The Application Property is comprised of four parcels. One of the parcels is developed
as a light industrial facility in operation since 1925; the remaining three parcels are residential
bungalows dating from 1928 to 1935. The buildings and uses on the property at 30 NW 34 have
been of a light industrial nature since 1925. Specifically, the business has operated as a wood
mill compatible with the design and furniture manufacturing businesses in and around the Design
District. Immediately to the west, along the west side of the North Miami Avenue, the
properties all have a T5-O designation. Prior to Miami 21, this segment of the west side of
North Miami Avenue was zoned "C-2" "Liberal Commercial", an intense commercial district
permitting heavy commercial uses, The current and previous zoning of the North Miami

Avenue Corridor recognize the existing and desired commercial character of North Miami
Avenue directly across the street from Midtown and the proposed WalMart SuperStore. The
blocks west of North Miami Avenue lack the transitional buffer desired by the Miami 21 Code's
transitional zoning philosophy.
Analysis for Requested LUP and Miami Zoning Amendments
The Owners/Co-Applicants seek a change from "T3-0" to "T4-O", consistent with the
successional zoning requirements of Section 7.1.2.8 of the Code as well as the companion land
use plan amendment from "Duplex Residential" to "Low Density Restricted Commercial." This
request will create an appropriate transition between the duplex residential ("T3-0") properties
to the west and the general commercial properties ("T5-O") to the east in Midtown and
Wynwood to the south. A similar request was recently approved on first reading by the City
Commission for properties on NW 31 Street and NW 32 Street (See Files No. 15-000831u and
15-0083zc). Second reading and final approval is scheduled for later this month.
The requested "T4-O" transect, the General Urban Zone, is consistent with the existing
uses. The General Urban Zone consists of a Mixed -Use but primarily residential urban fabric
with a range of building types, including row houses, small apartment Buildings, and bungalow
courts. In addition, the requested zoning change is consistent with the goals and objectives of
the Miami 21 Code because it complies with the successional zoning requirements. The
introduction of a "T4-0" Transect zone between "T3-0" and "T5-O" provides a buffer between
the residential neighborhood to the west and the commercial uses to the east and is also
compatible with the established development patterns of uses in the immediate neighborhood.

Exhibit 1
Miami 21, Article 7.1.2.8, c.2 (g) Analysis
The accompanying materials provide an analysis of the properties within a half
mile radius of the subject property and provide planning and zoning support for
the requested change in zoning transect.
Exhibit 1.1 consists of the Miami 21 Zoning map for the Property and the
abutting areas, depicting the Property's immediate proximity to properties
zoned T5-O, without a transitional T4-O transect between T5-O and T3.
Exhibit 1.2 depicts the Property's designation as "Duplex Residential" in the
City's Future Land Use Plan Map to the Comprehensive Neighborhood Plan
and the designation of the abutting areas to the west and south as "General
Commercial". This map confirms that there is no transitional area between the
General Commercial along N. Miami Avenue, in immediate proximity to
Midtown and the Duplex Residential areas to the west.
Exhibit 1.3 includes photographs of the existing condition of the property at 30
NW-3-4-Street, -a woodmilland- urns ure manufacturing -light in us1 facility
in operation since 1924. The facility has been in operation as a light industrial
building servicing the design businesses in the area in close proximity to the rail
yard that has since been developed as Midtown. The designation of this
property as duplex residential is not supported by its current and/or historical
use.

During our Pre -application meeting on June 1, 2015, the following request was presented:
A rezoning per Article 7, Section 7.1.2.8 (a) (3), to allow the successional rezoning of land. The
proposal is to change the zone the subject lots from T3-O to T4-O; and a Land Use change from
"Duplex Residential"to "Medium Density Multifamily Residential" to correspond with the proposed
rezoning.
Based on the request, staff has prepared the following comments, Please note, said comments are not
to be construed as a recommendation of approval or support of the proposal.
Staff's comments are as follows;
1. The deadline to submit a complete Rezoning and Land Use Change application is July 17, 2015,
Contact Ms. Christine Hwa, Hearing Boards Coordinator via e-mail at: CHwa@Miamigov.com or
by phone at 305-416-2031 for an appointment to submit the application.
a. Any restrictive covenant associated with the request, shall be submitted with the
application package.
2. Provide a letter of intent in accordance to Article 7, Section 7.1.2.8 (c) 2, schedule of outreach
meetings with the community, and a massing plan.
3. Include the acreage and square footage proposed to be rezoned on the survey.
4. Confirm requested Land Use; T4-O corresponds to Low Density Restrictive Commercial (Refer
to table attached).

5. A school concurrency letter is required; please contact the Hearing Boards Department at

8. A Traffic Study may be required upon further review of the submitted documents.
Be Advised: The Planning and Zoning Department reserves the right to make recommendations
pertaining to which Transect Zone will yield the most coherent zoning pattern in the context of the
immediate vicinity. Consequently, the City of Miami reserves the right to comment on the proposal as
more information is provided and may revise previous comments based on this supplementary
