These Applications come back before this City Commission on second reading with overwhelming support from the community and neighborhood associations, Buena Vista Heights Neighborhood Association, Inc. (BVH) and Buena Vista Stakeholders, Inc. (BVS) (collectively the "Associations"). Given the time that has passed since this Commission approved the ordinances on first reading, this letter provides a brief background, merit of the applications, and consistent support from the City's staff and boards and the community itself, and now a Declaration of Restrictive Covenants, reviewed to the satisfaction of BVH and BVS, providing for additional restrictions on the eastern portion of the Property'. Below is a synopsis of continuous support these Applications have received since Fall 2015. • Planning Department recommended approval of T4-O [Sept. 2015] • PZAB unanimous approval (11-0) for T4-O west, T4-L east [Oct 2015) • City Commission unanimous approval (5-0) on 1st Reading [Dec 2015)] • Letters of Support from 100% of Abutting Property Owners • Letters of Support from 40 + residents in Buena Vista neighborhood, including from Concepcion Vasquez (167 NW 42 d Street), the most affected neighbor to the east • BVH and BVS Support for proffered Declaration of Restrictive Covenants LRiAlie dence also brings to the attention of this tribunal certain misrepresentations and mischaracterizations put forth by 1 nearby proneyowner. Ms. Deborah Wright, which have unfairly impacted the Applicant and created unnecessary discord in the community. The Applicant has made significant accommodations, including (1) first, amending the original application to adjust proposed zoning on the eastern portion of the Property to T4-L despite the staff's recommendation of approval for T4-O for entire Property, and now (2) proffering a voluntary covenant to address additional concerns expressed after the Applications were already unanimously approved by this City Commission on first reading. See Exhibit A. The Applicant has letters of support from more than 40 residents and/or property owners, including from the owner of 167 NW 42nd Street, Concepcion Vasquez, the property directly to the east of the Property and most affected by the Applications, See Exhibit B composite of all letters of support. Brief History of Applications The Property is identified by the Miami -Dade County Property Appraiser as consisting of one folio (01-3124-020-0280), and has been one single tax folio and address for over 30 years. The Property has split zoning with T4-L on the westem portion and T3-L on the eastern portion. The Applicant originally filed the Applications in July of 2015 to consolidate the zoning as T4-O similar to the properties to the south, in response to practical difficulties discovered in adaptive reuse of the former daycare center located on the Property. The City's Planning Department recommended approval for the entirety of the Property to be rezoned to T4-0, recognizing that the Property historically had been and remains under 1 single address with 1 folio and single ownership and use. As shown in the attached historic aerial photos dating back to 1953, it is important to note that the Property has never been improved for residential use or structures. As a result of meetings with representatives of both BVH and BVS on site in September 2015, the Applicant voluntarily amended its application despite a positive staff recommendation and letters of support from abutting property owners, to reduce the proposed zoning for the eastern portion of the Property to T4-L. With mutual support from BVH and BVS at the Planning, Zoning, and Appeals Board ("PZAB") on October 21, 2015, the PZAB recommended unanimously 11-0 to approve the Applications as amended by the Applicant (T4-0 on the western portion; T4-L on the eastern portion). Then, on December 10, 2015, again with mutual support at the hearing from BVH and BVS, the City Commission approved the Applications as amended 5-0. Proper hearing notices were confirmed mailed and posted by the Office of Hearing Boards and BVH and BVS each requested input from its members during this process. Requested Rezoning is Consistent with Uniaue Site Conditions. and Applicable Criteria The site dating back as far as we can find was always consolidated as non-residential use. These Applications are critical for the Applicant's reasonable and productive use of its Property, as the current zoning does not recognize the historic Non-residential conditions and prevents any parking for commercial tenants to use the existing building. The T4-L transect zone would be the least permissive transect zone to allow surface parking or any commercial use on the eastern portion of the Property and recognizes the historic unified non-residential use. Because it reflects already existing site conditions and there is already a clear need and trend towards additional neighborhood oriented stores and services in the neighborhood, the rezoning is consistent with criteria set forth in Article 7.1.2.8 of Miami 21, and the City's Miami Comprehensive Neighborhood Plan ("MCNP"), as we have discussed at length and is presented into the record. Despite the fact that there are many transect zone boundaries present in the City of Miami that follow on a straight line, there is no law or codified standard in Miami 21 that assigns any legal standard (39553631;5) Submitted into the public record for item(s) PZ,7 & PZ.8 on O9/22/2036, City Clerk pertaining to the implementation of zoning along straight lines. There are examples all over the City of Miami where the zoning line is not straight, as it often reflects and respects unified ownership or existing conditions. For example, the City Commission has recently approved rezonings from T3-L or T3-R to T4-0 for irregularly shaped properties such as 5907 NE 5th Avenue in District 5 and 5445 Biscayne Boulevard in District 2 that are along a so-called "zoning line." In those matters, as is the case with the Application, the properties were abutting residential neighborhoods. The line itself is not more important than the history and current circumstances of the property's use and development, particularly in this instance where the Property is and has been 1 unified address and folio in common ownership. No house was torn down to assemble these properties. Because of the foregoing reasons, this rezoning also doesn't create any precedent necessarily as it is uniquely situated. All Competent Substantial Evidence Supports Approval of the Rezoning The City's planning department staff report and analysis concluded with a recommendation of approval of the Applications and serves as the competent substantial evidence upon which quasi- judicial decisions such as approving the Application must be based. The Application meets the City's technical criteria as outlined in Article 7 of Miami 21 and allows for reasonable productive use of the property, and as mentioned above, the Planning Department concluded their analysis with a recommendation for approval of the Applications. Site -specific zoning hearings in Florida are quasi-judicial in nature. Brevard County v. Synder, 627 So. 2d 429 (Fla. 1993). While a public hearing often involves testimony from experts as well as citizens and property owners, the Commission's decision must be based on competent substantial evidence. DeGroot v. Sheffield, 95 So. 2d 912 (Fla. 1957). Florida law makes clear that staff analysis is considered by its very nature competent substantial evidence. In contrast, the testimony of an objecting neighbor regarding a neighborhood zoning compatibility, a subject matter requiring zoning expertise of which the neighbor had none, is not based on competent substantial evidence. Metro Dade County v. Blumenthal, 675 So. 2d 598 (Ha. 3rd DCA 1996). The testimony and prior correspondence provided by Ms. Wright regarding her opinions about whether it is proper to permit any commercial use on the eastern portion of the Property is merely based on assertions and is not substantial competent evidence. In fact, there has been no substantial competent evidence to support a denial of the rezoning whatsoever. Serious Questions Surrounding Misrepresentations to the City Commission In February 2016, Ms. Deborah Wright, who owns property on the south side of NW 42nd Street, submitted days before a public hearing on the applications, correspondence in staunch opposition to any commercial use of the eastern portion of the Property. In researching the claims made by Ms. Wright and reviewing emails over the past few months clearly determined to obstruct and quash any further community dialogue between the Applicant and the Associations and residents in the area, it has become evident that Ms Wright has made material misrepresentations and misled this Commission, including fabrications of signatures presented at the last public hearing. It is our duty to this tribunal to correct the record and protect the integrity of this hearing process, and the rights of the Applicant, who has worked so diligently to make sure the community stakeholders and the Associations were comfortable with the zoning changes proposed. The points below highlight several of the most important points related to the merits of this Application and Ms. Wright's actions. {39553631;5} Submitted into the public record for item(s) PZ.7 & PZ.8 on 09/22/Z016, City Clerk 1. Ms. Wright claims steadfastly that no commercial uses can be permitted beyond the current zoning line because it would be an encroachment on the residential neighborhood and afffects her as a "resident". To start, Ms. Wright resides primarily in New York, and is a real estate investor in the neighborhood. She does not keep a homestead tax exemption. More importantly, it has come to our attention that she has regularly listed her home on www.VRBO.com, a short-term rental website for lodging up to 8 guests at any one time. The City of Miami Planning and Zoning Department Office of Zoning Memorandum dated August 11, 2016 provided a Zoning Interpretation regarding short term rentals. In particular, it reads, "As such, using a Single Family residence or Two Family -Housing (a duplex) within a T-3 transect zone to provide rental accommodations per night, per week, or anything less than a month would constitute an activity in violation of Miami 21." See Exhibit C. Thus, she is fighting against an alleged encroachment while she simultaneously engages in commercial activity in her own property that would only be allowed in the very same transect zone she opposes closer to NW 2nd Avenue. 2. Ms. Wright has improperly represented herself as a practicing attorney to convey influence and suggest that she speaks for a group of residents as if she was their attorney. In a letter to the City dated February 23, 2016, on legal letterhead, Ms. Wright states that she is a real estate attorney and developer. However, she is not a member of the Florida Bar. See attached Exhibit D. 3. The most disturbing discovery relates to potential fabrications of signatures to bolster a petition from alleged residents on 42nd Street. Ms. Wright circulated an alleged petition signed by neighboring residents and property owners who were opposed to the Application. Including Ms. Wright, only three signatories appear to be actual objectors, In particular, the owner of the property directly abutting to the east of the Property, Mr. Vasquez, who appears right on the Property Appraiser's website, signed a letter of support and the Applicant has been advised that the persons who signed Ms. Wright's petition using that address do not live there. 4. Finally, Ms. Wright has been attempting to discourage community dialogue. The Applicant has made attempts to engage Ms. Wright, but she has rebuffed invitations to participate in community meetings, going so far as threatening to sue the City. See Exhibit E. In conclusion, the Property has great potential for reuse and will contribute to the revitalization of the NW 2nd Avenue corridor. WITNESSETFI: WHEREAS, the Owner holds fee simple title to that certain real property located at 4201 NW 2nd Avenue, Miami, Florida, identified as Folio No. 01-3124-020-0280 (the "Site"); and WHEREAS, the majority of the Site adjacent to and fronting on NW 2nd Avenue is currently classified as T4-L on the Zoning Atlas of the City of Miami Zoning Code ("Zoning Atlas"); while the eastern portion of the Site, as more particularly described in Exhibit "A" (the "Subject Property"), is currently classified as T3-L on the City's Zoning Atlas; and WHEREAS, however, the property comprising the Site has been, since at least 1983, under common ownership and considered one unified development site with a single address and tax folio, improved with a 1- and 2-story commercial structure and outdoor playground area, which has been used as a day care center; and WHEREAS, on July 17, 2015, the Owner filed an application (the "Application") with the City's Planning and Zoning Department to amend the City's Zoning Atlas to change the zoning classification of the Site, including the Subject Property, to T4-O to unify the zoning of the entire Site to effectuate efficient and appropriate use and future redevelopment of the Site; and WHEREAS, the Planning Department recommended approval of the application as being consistent with the criteria contained in Article 7.1.2.8 of the City of Miami Zoning Code; and WHEREAS, after meetings with abutting property owners and representatives of the neighborhood associations representing residents and property owners in the neighborhood, Buena Vista Heights Neighborhood Association, Inc., and Buena Vista Stakeholders, Inc., including a meeting at the Site in September 2016, and mutual support by the Owner and the representatives of the aforementioned associations, the Applicant voluntarily amended the Application to reduce the proposed zoning for the Subject Property to T4-L to provide an appropriate and desired transition between the Site and the neighborhood to the east of the Subject Property; and {3628747i;5} Submitted into the public record for item(s) PZ.7 & P2.8 on 09/22/2016, City Clerk WHEREAS, on October 21, 2015, the Planning, Zoning and Appeals Board unanimously recommended approval of the Application, as amended (11-0); and WHEREAS, on December 10, 2015, after recommendation by the Planning, Zoning and Appeals Board, the City of Miami City Commission on first reading of the ordinance, reviewed the Application, as amended, for amendment to the City's Zoning Atlas, and determined the Application to be consistent with the criteria contained in Article 7.1.2.8 of the City of Miami Zoning Code; and WHEREAS, on , 2016, on second reading, the City Commission approved the Application, as amended, for amendment to the City's Zoning Atlas, pursuant to Ordinance No. attached hereto and made a part hereof as Exhibit "B"; and WHEREAS, the Owner desires to ensure that any future use and/or development of the Subject Property is consistent with both the current and future conditions of the surrounding Buena Vista Heights neighborhood, and respects the residential character of the neighborhood east of NW 2nd Avenue. NOW THEREFORE, the Owner, in order to assure the City that the representations made to the City will be abided by the Owner, its successors or assigns, freely, voluntarily and without duress makes the following covenants covering and running with the Subject Property: 1. Recitals. The foregoing recitals are true and correct and incorporated herein by reference. 2. Covenants Against the Subject Property. The Owner hereby declares the following restrictions against the use and development of the Subject Property: a. The Subject Property shall not be used as a nightclub, lounge, or other Alcohol Beverage Establishment, as defined in the City of Miami Zoning Code. b. No outdoor dining shall be located on the Subject Property. c. Commercial uses shall only be located on the ground floor of any building or structure on the Subject Property. No uses other than residential uses are permitted on additional floors above the ground floor of any building or structure on the Subject Property. Structures on the Subject Property shall have a maximum height of twenty-five (25) feet and no more than two (2) stories. d. In connection with any improvement of the Subject Property for parking facilities to support any new commercial uses on the Site, a buffer shall be provided along the eastern property line of the Subject Property consisting of trees planted at a maximum average spacing of thirty (30) feet on center within a minimum five (5) foot wide landscaped strip, and either (i) a fence with a life expectancy of at least ten (10) years or masonry wall with a measured height of six (6) feet, or (ii) landscaped hedge or shrubs which are of plant material that normally grow to a minimum height of six (6) feet, in accordance with City of Miami Zoning Code, to screen visibility from NW 42 Street. In the event the City of Miami Zoning Atlas is amended to allow for T4-L or greater for fifty (50) percent or more of the lots abutting the property to the north, south, or east, the Owner may request the release of this Declaration consistent with the procedures set forth in Section 6 herein. These restrictions shall be for the benefit of, and a limitation upon, all present and future owners of the Subject Property and for the public welfare. 4. Term of Covenant. This Declaration on the part of the Owner shall remain in full force and effect and shall be binding upon the Owner of the Subject Property, its successors in interest and assigns for an initial period of thirty (30) years from the date this instrument is recorded in the public records and shall be automatically extended for successive periods of ten (10) years, unless modified, amended or released prior to the expiration thereof. 5. Inspection and Enforcement. It is understood and agreed that any official inspector of the City of Miami may have the right at any time during normal working hours to enter upon the Subject Property for the purpose of investigating the use of the Subject Property, and for determining whether the conditions of this Declaration and the requirements of the City's building and zoning regulations are being complied with. An action to enforce the terms and conditions of this Declaration may be brought by the City and may be by action at law or in equity against any party or person violating or attempting to violate any covenants of this Declaration or provisions of the building and zoning regulations, either to restrain violations or to recover damages. This enforcement provision shall be in addition to any other remedies available under the law. 6. Amendment and Modification. This instrument may be modified, amended or released as to any portion of the Subject Property by a written instrument executed by the owner(s) of the fee -simple title to the Subject Property to be effected by such amendment, modification, or release and the City with the approval by the City Commission at a public hearing, which public hearing shall be applied for by, and be at the expense of the Owner. Any modification, amendment, or release of this Declaration will be subject to the approval as to content by the Zoning Administrator, and as to legal form by the City Attorney. The Buena Vista Heights Neighborhood Association, Inc., and Buena Vista Stakeholders, Inc., shall be given notice of any modification, amendment, or release of this Declaration. 7. Severability. Invalidation of any one of these covenants by judgment of Court shall not affect any of the other provisions of this Declaration, which shall remain in full force and effect. 8. Recording. This Declaration shall be filed of record among the Public Records of Miami -Dade County, Florida, at the cost of the Owner. In order to address the foregoing issue, it is necessary to look at the definitions and regulations listed in Miami 21, the City's current zoning ordinance: Articl.e 1.1 definitions: Single Family Residence: Detached Building used as permanent residence by a single housekeeping unit. The term is general, applying to all detached house types. Also known as Principal Dwelling Unit. Two Family -Housing: Two (2) Dwelling Units sharing a detached Building each Dwelling Unit of which provides a residence for a single housekeeping unit. Also known as a duplex. Multi -Family Housing: A Building or portion thereof, containing three or more Dwelling Units where each unit has direct access to the outside or to a common hall. Although technically it does sleep 8, we needed to use an air mattress and the living room couch in addition to the 4 bedrooms to sleep 4 adults and 4 teens. Back yard unusable and dirty, No outside furniture Grill is not nice ---- Family Dollar $25 version. Pikes. The neighborhood outside is transitional.... At best. But the fun/cool parts of the Wynwood area are close by. You have to drive to get to restaurants/bars/design district Fancy stores. NOT walking distance!! 15 min drive to South Beach w/o traffic, (1.5 hour drive with traffic.) 20 mins to Dolphins stadium ---- again WITHOUT traffic. 5 mins to AWESOME food at PROOF Pizza, Zak the Baker, Wynwood Kitchen , and Fireman Derek's World Famous Pies. Also the Wynwood Walls --- so cool!! This is a good place to stay if you just need an inexpensive home base for exploring Miami. Don't plan on hanging out in the house too much. Property was clean, in a quiet neighborhood, with a nice large backyard for lounging. There isn't a lot going on in the immediate surrounding area, but a rideshare will get you wherever you need to go (or you can bring a car and park on the property inside the gate). When we had questions, the owner was very responsive and helpful. I`d recommend this place and would stay here again myself. But the fun/cool parts of the Wynwood area are close by. You have to drive to get to restaurants/bars/design district fancy stores. NOT walking distance!! 15 min drive to South Beach w/o traffic. (1.5 hour drive with traffic.) 20 mins to Dolphins stadium ---- again WITHOUT traffic 5 mins to AWESOME food at PROOF Pizza, Zak the Baker, Wynwood Kitchen , and Fireman Derek's World Famous Pies. Also the Wynwood Walls --- so cool!! This is a good place to stay if you just need an inexpensive home base for exploring Miami. Don't plan on hanging out in the house too much. The residents have expressed their opposition, as noted in our previous correspondence and at the last couple Public Hearings. However, the owners of the property are insisting on more and more "meetings" with the community, where they treat neighbors to dinner, scare them into "safety" concerns, exhaust them to the point of agreement or lack of participation, and intimidate them into feeling that if their proposal isn't accepted (which has not changed, and suggests parking on the residential portion), the neighborhood will remain stagnant and "unsafe". This sort of intimidation and the efforts at exhausting the neighbors into acceptance and submission is unacceptable (please see below email and attachment for yet another "community meeting" on the proposed parking lot) and should be discouraged by your offices. I am going to write to the Board about this continued harassment effort at pushing the same agenda --it's ridiculous. Clearly, i will not be there on one days notice, and no part of the neighborhood is obligated to keep spending time discussing the same proposal --note that I remain opposed to this same proposed rezoning, and will make that clear to the Commissioners. Social pressure can't be the way to exhaust a neighborhood into submission to a proposal that has already been rejected.
