HomeMy WebLinkAboutR-16-0434City of Miami Legislation Resolution: R-16-0434 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-01157 Final Action Date: 9/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), SUPPORTING THE CREATION OF THE MANA-WYNWOOD COMMUNITY DEVELOPMENT DISTRICT ("CDD") BY MANNIGAN HOLDINGS, LLC, MEGAN HOLDINGS, LLC, MELANIE HOLDINGS, LLC, MIZRACHI HOLDINGS, LLC, WYNWOOD HOLDINGS, LLC, 2294 NW 2ND AVENUE REALTY, LLC, MAPTON HOLDINGS, LLC, MALUX REALTY, LLC, MILANA HOLDINGS, LLC, MILLIE REALTY, LLC, AND 2450 NORTHWEST REALTY, LLC, (COLLECTIVELY, "DEVELOPER") FOR THE SITE GENERALLY BOUNDED ON THE NORTH BY NORTHWEST 24TH STREET INCLUDING SPECIFIC PARCELS FRONTING NORTHWEST 24TH STREET TO THE NORTH, NORTHWEST 6TH AVENUE TO THE WEST, NORTHWEST 22ND STREET TO THE SOUTH, AND NORTHWEST 2ND AVENUE TO THE EAST, MIAMI, FLORIDA, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED AND AS DEPICTED IN THE BOUNDARY MAP ATTACHED AS EXHIBIT "B" ("SITE"); ENCOURAGING THE MIAMI-DADE BOARD OF COUNTY COMMISSIONERS ("COUNTY COMMISSION") TO APPROVE A PETITION SUBMITTED BY THE DEVELOPER TO CREATE THE CDD; AND SUPPORTING THE ESTABLISHMENT BY THE COUNTY COMMISSION OF A MULTI -PURPOSE SPECIAL TAXING DISTRICT ON THE SITE. WHEREAS, pursuant to Ordinance No. 13632, adopted September 8, 2016, Mannigan Holdings, LLC, Megan Holdings, LLC, Melanie Holdings, LLC, Mizrachi Holdings, LLC, Wynwood Holdings, LLC, 2294 NW 2ND Avenue Realty, LLC, Mapton Holdings, LLC, Malux Realty, LLC, Milana Holdings, LLC, Millie Realty, LLC, and 2450 Northwest Realty, LLC, (collectively, the "Developer") and the City of Miami ("City") entered into a Development Agreement ("Agreement"); and WHEREAS, pursuant to Ordinance No. 13631, adopted September 8, 2016, the City Commission approved the Rezoning for the site generally bounded on the North by Northwest 24th Street including specific parcels fronting Northwest 24th Street to the North, Northwest 6th Avenue to the West, Northwest 22nd Street to the South, and Northwest 2nd Avenue to the East, Miami, Florida, as described in Exhibit "A", attached and incorporated ("Site"), from D1, "Work Place", and T5-O, "Urban Center Zone" with a Neighborhood Revitalization District NRD-1 Overlay, to Mana Special Area Plan with a Neighborhood Revitalization District NRD-1 Overlay with T5-O, T6-8a-O, T6-8b-O, and T6-12-0, as described in the Mana Wynwood Concept Book ("Rezoning"); and WHEREAS, consistent with the Agreement, the Rezoning, and the Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida, as amended, the City is committed to facilitating the development of the Site with an urban infill project with a mix of uses including substantial public open spaces, enhanced pedestrian areas, and enhanced mass transit facilities, known as the Mana-Wynwood Project ("Project"); and WHEREAS, the City supports the creation of the CDD to assist in funding and constructing various onsite and offsite infrastructure and related public improvements for the Project; and City of Miami Page 1 of 2 File Id: 16-01157 (Version: 2) Printed On: 5/24/2018 File Number: 16-01157 Enactment Number: R-16-0434 WHEREAS, the various onsite and offsite infrastructure and related public improvements to be provided by the CDD for the Project shall not conflict with the special assessment for services levied by the Wynwood Business Improvement District; and WHEREAS, the City further supports the creation of a multi -purpose special taxing district by the Miami -Dade Board of County Commissioners ("County Commission") over the lands to be included within the CDD to function in the event the CDD fails to maintain its public infrastructure; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and incorporated as if fully set forth in this section. Section 2. The City Commission supports the creation of the CDD for the Site. Section 3. The City Commission further supports the creation of a multi -purpose special taxing district required by the County Commission, which shall remain dormant unless determined by the County Commission to be needed to maintain public infrastructure serving the Site in the event that the CDD or the property owners' association fails to do so. Section 4. The City Commission encourages the County Commission to approve a petition submitted by the Developer to create the CDD and underlying special taxing district consistent with the Agreement. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
