HomeMy WebLinkAboutR-16-0408City of Miami Legislation Resolution: R-16-0408 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-01250 Final Action Date: 9/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO UPDATE THE CITY OF MIAMI'S STORMWATER MANAGEMENT MASTER PLAN TO COMPLY WITH THE NATIONAL FLOOD INSURANCE PROGRAM -COMMUNITY RATING SYSTEM ("NFIP-CRS"); FURTHER DIRECTING THE CITY MANAGER TO ENSURE THAT SEA LEVEL RISE ESTIMATES NOT ADDRESSED IN THE ORIGINAL PLAN ARE CONSIDERED IN THE MASTER PLAN AND SERVE AS A TOOL TO ANALYZE AREAS OF FLOOD CONCERNS WHICH IMPACT THREATS OF SEA LEVEL RISE, PUBLIC SAFETY ISSUES AND PROPERTY LOSS RESULTING FROM STORM WATERS; FURTHER RECOMMENDING APPROVAL OF THE FINDINGS, MEASURES AND LOCATIONS CONTAINED THEREIN. WHEREAS, pursuant to Resolution No. 11-0070, adopted on February 24, 2011, the City Commission adopted the City of Miami ("City") Phase I Stormwater Management Master Plan, dated January, 2011; and WHEREAS, pursuant to Resolution No. 12-00394, adopted on May 10, 2012, the City Commission adopted the City's Phase II Stormwater Management Master Plan, dated February, 2012; and WHEREAS, certification from the National Flood Insurance Program -Community Rating System ("NFIP-CRS") requires the Stormwater Master Plan be implemented within five years; and WHEREAS, the current Stormwater Master Plan is outdated and must be updated to come into compliance with the NFIP-CRS; and WHEREAS, the primary objective of those studies were to analyze areas of flood concern which impact public safety and property loss; and WHEREAS, the City's Phase I and Phase II Stormwater Master Plans are obsolete due to its failure to address the issue of Sea Level Rise as part of public safety and property loss; and WHEREAS, Sea Level Rise is a pressing issue which directly impacts the City's original objectives of ensuring continued public safety and minimizing property loss; and WHEREAS, the updated Stormwater Management Master Plan will satisfy the NFIP-CRS requirements for improvements to the City of Miami's NFIP-CRS ranking; and WHEREAS, the updated Stormwater Management Master Plan will also allow for the pressing issue of Sea Level Rise, which was not originally discussed, to be addressed and incorporated into a New Stormwater Master Plan; and City of Miami Page 1 of 2 File Id: 16-01250 (Version: 1) Printed On: 5/25/2018 File Number: 16-01250 Enactment Number: R-16-0408 WHEREAS, the findings will further allow the City to develop a comprehensive Capital Improvement Plan identifying drainage improvements and enhancements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is directed to update the City's Stormwater Management Master Plan to ensure continued compliance with the NFIP-CRS to ensure the residents of the City enjoy the lowest possible flood insurance premiums, to ensure that sea level rise estimates not addressed in the original plan are considered in the master plan, and to analyze areas at higher risk of flooding due to sea level rise in order to ensure public safety and minimal property loss resulting from flooding in the updated Stormwater Management Master Plan. Section 3. This Resolution shall become effective upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
