HomeMy WebLinkAboutExhibitA RESOLUTION OF THE VIRGINIA KEY ADVISORY BOARD RECOMMENDING TO THE MIAMI CITY COMMISSION ("COMMISSION") TO REJECT ALL PROPOSALS SUBMITTED IN RESPONSE TO THE CITY OF MIAMI'S REQUEST FOR PROPOSALS ("RFP") NO. 12-14-077 LEASE OF CITY -OWNED WATERFRONT PROPERTY FOR MARINAS/RESTAURANT/SHIP' S STORE USES ("VIRGINIA KEY MARINA RFP"); RECOMMENDING THAT THE CITY OF MIAMI ISSUE A NEW VIRGINIA KEY MARINA RFP THAT COMPLIES WITH THE VIRGINIA KEY MASTER PLAN ADOPTED BY THE COMMISSION ON JULY 22, 2010 BY RESOLUTION R-10-0331; FURTHER DIRECTING THE BOARD LIAISON TO FORWARD A COPY OF THIS RESOLUTION TO THE OFFICIALS STATED HEREIN. WHEREAS, the City of Miami ("City") issued a Request for Proposals ("RFP") No. 12-14-077 Lease of City -Owned Waterfront Property For Marinas/Restaurant/Ship's Store Uses ("Virginia Key Marina RFP"), which closed on February 1, 2016; and WHEREAS, the City received three (3) proposals in response to the Virginia Key Marina REP; and WHEREAS, pursuant to Section 18-86(c)(6) of the Code of the City of Miami, as amended ("City Code"), the Selection Committee recommended the City enter into contract negotiations with the top ranked proposer of the Virginia Key Marina RFP, Virginia Key, LLC ("RCI Group"); and WHEREAS, pursuant to Section 18-86(c)(6)(a) of the City Code, the City Manager approved the recommendation of the Selection Committee on or about March 16, 2016; and WHEREAS, on or about April 12, 2016, the second ranked proposer, Virginia Key SMI, LLC a/k/a Suntex Marinas ("Suntex") and the third ranked proposer, New Rickenbacker Marina, LLC ("Tifon"), individually filed bid protests; and WHEREAS, on or about May 10, 2016, the Director of the Department of Real Estate and Asset Management denied the bid protests filed by Suntex and Tifon; and WHEREAS, on May 24, 2016, the Virginia Key Advisory Board ("Board") unanimously passed a resolution urging the City Commission to respect the Virginia Key Master Plan and further urging the City Commission to remove the wet slips from the basin in the Virginia Key Marina RFP; and WHEREAS, the Miami City Commission ("Commission") held a special meeting on June 22, 2016 and denied the bid protests; and WHEREAS, on June 28, 2016, the Board held a public meeting and discussed the Virginia Key Marina RFP; and WHEREAS, the first ranked proposer, RCI Group, presented its proposal to the Virginia Key Advisory Board at the June 28, 2016 regular Board meeting; and WHEREAS, the Board heard public comment on the Virginia Key Marina RFP and RCI Group's presentation; and WHEREAS, the Board does not favor the top ranked proposer, the second ranked proposer, nor the third ranked proposer of the Virginia Key Marina RFP; NOW, THEREFORE, BE IT RESOLVED BY THE VIRGINIA KEY ADVISORY BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Board recommends that the Commission reject all proposals submitted in response to the City of Miami's Request For Proposals ("RFP") No. 12-14- 077 Lease of City -Owned Waterfront Property for Marinas/Restaurant/Ship' s Store Uses. Section 3. The Board further recommends that the City issue a new RFP for the Virginia Key Marina that complies with the original Virginia Key Master Plan, adopted unanimously by the Commission on July 22, 2010 by Resolution R-10-0331. Section 4. The Board Liaison is directed to forward a copy of this Resolution to the members of the Commission, Mayor Tomas Regalado, City Manager Daniel J. Alfonso, and the City Clerk. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Board Chairperson. PASSED AND ADOPTED THIS 28th DAY OF JUNE, 2016. Gregory W. Bush Chairperson
