Director - City Manages Page 1 of 2 Background Information: In the Fall of 2014 the Department of Planning and Zoning received notice from Miami -Dade County's Department of Cultural affairs that the City of Miami was not in compliance with County Code Section 2-11.15 entitled "Art in Public Places Program". Whereas all municipalities in the incorporated area of Miami -Dade County must comply with said requirement. Subsequently, the Department of Planning and Zoning has been working with CITP to ensure compliance. Failure to comply with Section 2-11.15 may result in immediate suspension of SNP and GOB payments to the City. In an effort to meet the mandated requirement, the City has contracted with Miami -Dade County Department of Cultural Affairs to administer and commission the public art on City projects. As a result, the Department of Planning and Zoning conducted a thorough analysis of Public Art Ordinances locally and across the country. Since the County started to enforce the Public Art requirement several municipalities in Miami -Dade County moved to adopt their own Public Art Ordinances. The Department is proposing that the City adopt its own Public Art Ordinance as presented. Said ordinance will bring the City into compliance with Miami -Dade County requirements and will give the City jurisdiction on the selection and commissioning of public art within the City. This ordinance will apply to applicable public and private development. The City's approximate fee to be paid to MDC in 2016 is $180k which represents a 15% administrative fee and 15% maintenance fee of the 1.5% on Capital Improvement Projects (CIP) (See attached Exhibit A.). The amount contracted will be reverted to the City in the event the city starts its own Art in Public Places Program. The cost of the operation for the first year has been conservatively calculated in the amount of $ 179k, which is slightly below of the amount the city would pay the county to solely administer City public art projects. Verses reviewing city and private development while generating up to $13.2 million towards public art from private development.
