BVEHNA does not opposed or support the Appeal the HEP Board decision
1. Due Process and Rule of Law: The HEP Board is empowered by the City Charter to act in the
manner it has opted to.
a. CITY CHARTER Sec. 62-28. - Functions, powers and duties, generally.
In addition to such other powers, duties, and authority as may be set forth elsewhere in this Code and
in the zoning ordinance, the board is hereby authorized to:
• Maintain and update files from the county historic survey within the city for the purpose of
identifying and preserving those properties and neighborhoods of special historic, aesthetic,
architectural, archeological, paleontological, cultural, social, or political value or interest.
• Serve as a quasi-judicial instrument to designate historic sites, historic districts, and
archeological zones pursuant to chapter 23 of the City Code.
2. Current Use versus Future Use:
a. The property is currently a single building with two floors consisting of retail and
restaurant on the first floor and Work/Live units on the 2nd floor. The building has
overwhelming characteristics similar to its block and context. Being registered as a
contributing structure does not affect the current use of the property.
3. NE 2nd Avenue primary Frontage:
a. The commercial corridor along NE 2"d Ave current and future intensity, use and design
should be clearly delineated from the interior streets such as 45 and 46 street. On NE
2nd Ave, you have many properties that are not deemed contributing structures. This
property in question is located on NE 2nd Ave. The property should be evaluated using
the same guidelines as the abutting properties.
