HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00589 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO GRANT OSPREY APARTMENTS, LLC AN EXTENSION OF TIME TO START CONSTRUCTION, FOR THE DEVELOPMENT OF AFFORDABLE HOUSING, ON THE PROPERTY LOCATED AT 5329 NORTHWEST 17 AVENUE, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, FROM JUNE 15, 2016 TO DECEMBER 31, 2016, AND TO GRANT AN EXTENSION OF THE CONSTRUCTION COMPLETION DEADLINE TO DECEMBER 31, 2018; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 07-0461, adopted on August 1, 2007, the City Commission authorized the transfer of the property located at 5329 Northwest 17 Avenue, Miami, Florida, to Carrfour Supportive Housing, Inc. ("Carrfour") for the development of mixed -use affordable housing; and WHEREAS, pursuant to Resolution No. 08-0689, adopted on December 11, 2008, the City Commission approved an assignment of the Purchase and Sale Agreement from Carrfour to Osprey Apartments, LLC, ("Osprey") for the development of mixed -used affordable housing; and WHEREAS, on June 15, 2015, the City of Miami ("City") transferred the property by Quit -Claim Deed to Osprey requiring that construction begin by June 15, 2016 and be completed by June 15, 2018; and WHEREAS, Osprey has informed the City that they will be unable to start construction by June 15, 2016 because of zoning issues requiring changes to the plans; and WHEREAS, the project is currently fully funded and the affordable housing to be provided in the community is needed now more than ever; and WHEREAS, the City Administration recommends that an extension of time be granted to Osprey to begin construction on the property located at 5329 Northwest 17 Avenue, Miami, Florida from June 15, 2016 to December 31, 2016, and further recommends that an extension to the construction completion deadline to December 31, 2018 be granted; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to grant Osprey an extension of time to start construction, for the development of affordable housing, on the property located at 5329 Northwest 17 City of Miami Page 1 of 2 File Id: 16-00589 (Version: 1) Printed On: 5/11/2016 File Number: 16-00589 Avenue, Miami, Florida, legally described in Exhibit "A", attached and incorporated, from June 15, 2016 to December 31, 2016, and to grant an extension of time to the construction completion deadline to December 31, 2018. Section 3. The City Manager is further authorized {1} to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CEO RRECTNESS: VI,`TORIAJVIENDEZ CITY ATTORNEY 1, Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
