Law Department Matter ID No. Purpose of Item: A Resolution accepting a Perpetual Easement from MDM Retail, Ltd. for ingress and egress purposes over and upon a portion of the sidewalk located on MET Square property abutting SE 3 Avenue and authorizing the City Manager to execute and record said Perpetual Easement. Background Information: The MET Square development project located at 300 SE 3 Street was approved under a Major Use Special Permit modified by a Mediated Action Plan. The approved project includes a vehicular drop-off area on SE 3 Avenue abutting the project site. The widened drop-off area requires pedestrians to by-pass the drop-off area by using sidewalk located on the MET Square private property. The City desires that public ingress and egress access to the sidewalk located on private property be assured and, to that end, the owner of the property has offered to grant a Perpetual Easement to the City for public ingress and egress purposes. MDM Retail, Ltd. will construct, maintain and assume liability responsibility for the portion of sidewalk located on private property. The purpose of the easement is to ensure that the general public will have ingress and egress access to the portion of sidewalk located in the easement area to by-pass the drop-off area.
