A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO.1 TO
REQUEST FOR QUALIFICATIONS CONTRACT NO. 489328, IN SUBSTANTIALLY
THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND VARIOUS
PRE -QUALIFIED VENDORS FOR LOT CLEARING SERVICES, AMENDING
SECTION 2.9, "PROCEDURES FOR OBTAINING INVITATION FOR QUOTATION",
AND SECTION 2.8, "METHOD OF AWARD", AND ADDING SECTION 2.33,
"CONSUMER PRICE INDEX"; FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS TO THE
CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE.
WHEREAS, on July 9, 2015, the City Commission adopted Resolution No. 15-0290, approving
the proposals received, pursuant to Request for Qualifications ("RFQ") Contract No. 489328
("Contract"), and approving the establishment of a pre -qualification list comprised of four (4) qualified
proposers, as listed alphabetically in "Exhibit A", attached herein, to provide lot clearing services for
the Code Compliance Department on an as needed basis; and
WHEREAS, lot clearing services ensure that properties within the City of Miami ("City") are
maintained free of debris and excessive vegetative growth; and
WHEREAS, in order to prohibit qualified vendors from bidding excessive prices for the lot clearing
services, language incorporating a not to exceed price per square foot is being added to Section 2.9,
"Procedures for Obtaining Invitation for Quotation", for Category A Services, Vegetative Debris and
Non -Vegetative Debris, and Category B Services, Major Non -Vegetative Debris; and
WHEREAS, in Section 2.8,"Method of Award", language will be incorporated to indicate that
pre -qualified vendors will be contacted by the Code Compliance Department to participate in an
Invitation for Quote process when a need for lot clearing services arise; and
WHEREAS, due to the fluctuating price of fuel, Section 2.33, "Consumer Price Index", is being
added to the Contract to allow for the ability to increase/decrease the not to exceed prices pursuant
to the current Consumer Price Index; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized {1 } to execute Amendment No. 1 to the
Contract, in substantially the attached form, between the City and various pre -qualified vendors for lot

clearing services, amending Section 2.9, "Procedure for Obtaining Invitation for Quotation", and
Section 2.8, "Method of Award", and adding Section 2.33, "Consumer Price Index".
Section 3. The City Manager is further authorized {1} to execute any amendments, extensions,
and modifications to the Contract, in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission or upon date stated
herein, whichever is later.
