HomeMy WebLinkAboutR-16-0220City of Miami Legislation Resolution: R-16-0220 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00419 Final Action Date: 5/12/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE PURCHASE OF EVIDENCE.COM UNLIMITED LICENSES AND TASER ASSURANCE PLAN, WHICH INCLUDES SOFTWARE STORAGE FROM TASER INTERNATIONAL, INC., FOR THE MIAMI POLICE DEPARTMENT ("MPD"), ON AN AS NEEDED CONTRACTUAL BASIS FOR A PERIOD OF ONE (1) YEAR, FOR AN INITIAL PURCHASE AMOUNT OF $88,920.00, RENEWABLE ANNUALLY SUBJECT TO AN ANNUAL FINDING OF SOLE SOURCE BY THE CHIEF PROCUREMENT OFFICER AND APPROVED BY THE CITY MANAGER; ALLOCATING FUNDS FROM THE MPD'S GENERAL FUND, ACCOUNT CODE NO. 00001.190101.552000.0000.00000, WITH FUTURE PURCHASES TO BE ALLOCATED FROM THE VARIOUS SOURCES OF FUNDS FROM THE MPD, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the Miami Police Department ("MPD") initiated a body worn camera pilot program in 2014 and purchased fifty (50) Axon Flex Body Video Cameras ("Axon Cameras") to analyze the perceptions of police officers toward body worn cameras and the effectiveness of body worn cameras during officer and citizen encounters; and WHEREAS, pursuant to Resolution No. 15-0445, adopted on October 8, 2015, the Risk Management Department, on behalf of the MPD, purchased a supplementary fifty (50) Axon Cameras, accessories, and related equipment to continue equipping police personnel; and WHEREAS, Taser International, Inc. is the sole manufacturer of the Axon Cameras which are only compatible with the Evidence.com data storage system; and WHEREAS, the purchase of Evidence.com Unlimited Licenses allows the MPD to retain unlimited data storage of Axon Camera recordings which is necessary to preserve evidence and continue the MPD's effort in reducing injuries to officers and subjects; and WHEREAS, the Taser Assurance Plan provides the MPD with an extended warranty coverage of hardware, spare Axon Cameras, and upgraded models of the Axon Cameras; and City of Miami Page 1 of 3 File Id: 16-00419 (Version: 11 Printed On: 5/4/2018 File Number: 16-00419 Enactment Number: R-16-0220 WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has made a finding that Taser International, Inc. is the sole source provider of the Evidence.com Unlimited Licenses and Taser Assurance Plan; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and the purchase of Evidence.com Unlimited Licenses and Taser Assurance Plan, which includes software storage, be approved; and WHEREAS, the City Manager is authorized to execute the Agreement, in substantially the attached form, inclusive of any amendments with Taser International, Inc., for the purchase of the Evidence.com Unlimited Licenses and Taser Assurance Plan, which includes software storage; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures, are waived, and the City Manager is authorized to enter into an Agreement with Taser International, Inc. for the purchase of Evidence.com Unlimited Licenses and the Taser Assurance Plan, for the MPD on an as needed contractual basis, for a period of one (1) year, renewable annually, subject to an annual finding of sole source by the Chief Procurement Officer and approval by the City Manager, for an initial purchase amount of $88,920.00, with funds allocated from the MPD's General Fund, Account Code No. 00001.190101.552000.0000.00000 and future purchases to be allocated from the various sources of funds from the MPD, subject to the availability of funds and budgetary approval at the time of need. Section 3. The City Manager is authorized {1} to execute an Agreement, in substantially the attached form, and negotiate and execute all other documents and modifications to said Agreement, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miami Page 2 of 3 File Id: 16-00419 (Version: 11 Printed On: 5/4/2018 File Number: 16-00419 Enactment Number: R-16-0220 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
