On April 25, 2008, MarineMax East, Inc., a Delaware corporation ("MarineMax") filed
an FDOR Form 452 (the "Form") with the property appraiser for Miami -Dade County. A copy
of the Form is attached hereto as Exhibit "A". In filing this form, MarineMax asserted a claim of
adverse possession without color of title to a 2,233 square foot strip (the "Strip") which is more
particularly described in the Form. The claim is based on the fact that the property (which most
recently, in the 1920s, was titled in the name of Krames Corlett Company) has been possessed
and used by MarineMax or its predecessors in title since the 1920s.
Because the Strip had never been entered on the tax rolls, the property appraiser gave the
Strip the Folio number 01-3207-016-3442 and the Strip was added to the Miami Dade tax rolls.
Since 2008, Marine Max has paid all of the tax bills for the Strip.
At this time, the seven year period (which commenced upon the filing of FTOR form
452), and which time period is required to formally established ownership by adverse possession,
has expired. Since the filing, there has been no interruption in MarineMax claim of adverse
possession. Accordingly, per Florida law relating to adverse possession, title has vested in
MarineMax.
