Per your 10/22/15 memo, you allowed raises for all employees with the exception of a small amount of executive employees under your direction. According to your memo, "all other executives and non -bargaining employees in the Law Department" were not excluded to receive the across the board increase of 5% that was paid at 2.5% around October 1st and the other 2.5% around the employees' anniversary date. I received the COLA for unclassified employees last fiscal year; however, when I was not paid the 2.5% increase on the 11/6/15 pay date, I inquired with Human Resources. They informed that my contract, along with one other executive's, was silent on COLA. Therefore, you excluded us from the across the board increase, since executive contracts negotiated with the Commission state that the negotiated salary is "to remain in effect until changed by the City Commission." Other City contracts approved by the Commission that addressed i -uLA stated they receive "same as granted to the members of the classified or unclassified service, whichever is higher." However, if one contract states that an employee receives the higher of COLAs awarded to two classes of employees (unclassified and classified), it does not imply that if another contract is silent on the issue, an across the board increase intended for the contract holder's employee class (unclassified) should be denied. Also, the contract clause stating that the salary is "to remain in effect until changed by the City Commission" does not specify how such salary changes are to be made. Changes to salary can either be effected via Commission approval of the City's annual budget, which include COLA increases, or effected via a Commission approved amendment to the executive contract. When fiscal year 2015 across the board increases of 2.4% were approved by the Commission for unclassified employees, both contract executives including myself, that were denied the 2016 increases, received the 2015 increases. As in 2016, the 2.4% increase for my salary was included in the 2015 departmental budget for my position and approved by the Commissioners under adopted resolution R-14-0362 in September 2014. The resolution also contained identical language as 2016 stating (Section 14) that "with the exception of those positions in which the salary is established by City Commission action, the City Manager is further authorized to establish the salaries of those employees in executive and staff positions in accordance with the executive and staff pay plan." Accordingly, you did not have the authority to withhold the COLA increase which was approved by the Commission pursuant to budget resolution 15-0416. This clause is especially relevant as it also protects the integrity of the independence of our Office from City management pursuant to Chapter 48 of the City Charter, which was violated by your action. So we have identical situations with different outcomes. This is an example where past practice clarified the ambiguities in our different contract interpretations when COLA is not specifidally addressed. Accordingly, a COLA payout in 2016 is supported by the contract and was previously approved by the Commission. Finally, the budget process began almost six months ago, and my budget went through multiple levels of budgetary review by your staff prior to your review and presentation to the Commissioners. As your peer, I hope that going forward budget issues are identified in a timely manner, and that we all work together to think things through prior to taking action. In light of these new facts, please let me know how you would like to proceed to rectify the situation.
