A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID RECEIVED, MARCH 22, 2016, PURSUANT TO INVITATION
TO BID ("ITB") NO. 15-16-017, FROM CHEROKEE ENTERPRISES, INC., THE
LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, FOR THE DOUGLAS PARK
ENVIRONMENTAL REMEDIATION DISTRICT 2 PROJECT IN THE AMOUNT OF
$4,484,185.00 FOR THE SCOPE OF WORK PLUS ATEN PERCENT (10%) OWNER
CONTINGENCY AMOUNT OF $44.8,418.50, FOR A TOTAL NOT TO EXCEED
AWARD VALUE OF $4,932,603.50; ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENTS AND TRANSPORTATION PROJECT NO. 40613; AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, CONSISTING OF THE ITB DOCUMENTS AND ATTACHMENTS,
AND TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING
AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the Procurement Department ("Department") issued Invitation to Bid ("ITB") No.
15-16-017 for construction services for the Douglas Park Environmental Remediation District 2 Project
("Project"); and
WHEREAS, three (3) bids were received by the Office of the City Clerk on March 22, 2016; and
WHEREAS, the Department has determined Cherokee Enterprises, Inc. ("Cherokee") to be the
lowest responsive and responsible bidder; and
WHEREAS, the Bid Security List indicates that Cherokee's bid was in the amount of
$4,484,185.00; and
WHEREAS, the City Manager requests authorization to execute a contract with Cherokee in the
amount of $4,484,185.00, plus a ten percent (10%) owner contingency amount of $448,418.50, for a
total not to exceed award value of $4,932,603.50; and
WHEREAS, funds in the amount of 54,932,603.50 are to be allocated from Capital Improvements
and Transportation Program ("CITP") Project No, 40613;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The bid received March 22, 2016, pursuant to ITB No. 15-16-017 from Cherokee
Enterprises, Inc., the lowest responsive and responsible bidder, for the Project in the amount of
$4,484,185.00 for the scope of work, plus a ten percent (10%) owner contingency amount of

Section 3. The City Manager {11 is authorized to execute an agreement, in substantially the
attached form, consisting of the ITB documents and attachments, and to negotiate and execute all
other documents, including amendments and modifications to said agreement, in a form acceptable to
the City Attorney, for said purpose.
Section 4. This Resolution shall become effective i rnediately upon its adoption and signature of

Footnotes:
{1} The herein authorization is further subject to compliance with all regulations that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten
(10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
