HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00337 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING AN INCREASE IN SOLE SOURCE CONTRACT NO. 13-14-004 ("AGREEMENT"), FOR THE SCAVENGER 2000 DECONTAMINATION BOAT, IN AN AMOUNT NOT TO EXCEED $50,000.00, THEREBY INCREASING THE CONTRACT CAPACITY FROM AN AMOUNT NOT TO EXCEED $650,000.00 TO AN AMOUNT NOT TO EXCEED $700,000.00; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2 TO THE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND WATER MANAGEMENT TECHNOLOGIES, INC., FOR SAID PURPOSE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the current Sole Source Contract No. 13-14-004 ("Agreement") between the City of Miami ("City") and Water Management Technologies, Inc., for the Scavenger 2000 Decontamination Boat, pursuant to Resolution No. 13-0449, adopted November 21, 2013, limits compensation in an amount not to exceed $600,000.00; and WHEREAS, on March 26, 2015, the City Commission adopted Resolution No. 15-0149, authorizing an increase to the Agreement, for the Scavenger 2000 Decontamination Boat, in an amount not to exceed $50,000.00, thereby increasing the contract capacity from an amount not to exceed $600,000.00 to an amount not to exceed $650,000.00; and WHEREAS, due to the increasing need for cleaning and decontaminating the Miami River, Biscayne Bay, and all navigable tributaries, it has been deemed necessary to increase the contract by $50,000.00 for Fiscal Year 2015-2016; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An increase to the Agreement, for the Scavenger 2000 Decontamination Boat, in an amount not to exceed $50,000.00, thereby increasing the contract capacity from an amount not to exceed $650,000.00 to an amount not to exceed $700,000.00, is authorized. Section 3. The City Manager is authorized {1} to execute Amendment No. 2 to the Agreement, in substantially the attached form, between the City and Water Management Technologies, Inc., for said purpose. Section 4. The City Manager is further authorized {1} to negotiate and execute all other documents, including amendments and modifications to said Agreement, in a form acceptable to the City of Miami Page 1 of 2 File Id: 16-00337 (Version: 1) Printed On: 3/25/2016 File Number: 16-00337 city attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} AP ROVED AS TO FORM AND CORRECTNESS: ) VICTORIA MINDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
