FOR THE FIRE -RESCUE DEPARTMENT, PURSUANT TO SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, UTILIZING THE COMPETITIVELY BID AND EXISTING POLK COUNTY CONTRACT NO. 13-407, EFFECTIVE THROUGH SEPTEMBER 30, 2016, WITH TWO (2) ONE (1) YEAR AUTOMATIC RENEWALS, SUBJECT TO ANY EXTENSIONS AND/OR REPLACEMENT CONTRACTS BY POLK COUNTY; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS OF THE END USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A SUPPLEMENTAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AMENDMENTS TO THE SUPPLEMENTAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the Fire -Rescue Department's ("Fire") "accessing" of the Polk County Contract No. 13-407 for Annual Firefighter Physicals will enable Fire to utilize an approved vendor with the necessary equipment needed to provide examination services; and WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer determined that said Polk County contract was entered into pursuant to a competitive process in compliance with the City of Miami's laws, policies and procedures; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The procurement of the Annual Firefighter Physicals with Life Extension Clinics, Inc. for the Fire -Rescue Department, pursuant to Section 18-111 of the City Code, utilizing the competitively bid and existing Polk County Contract No. 13-407, effective through September 30, 2016, with two (2) one (1) year automatic renewals, subject to any extensions and/or replacement contracts by Polk County, is approved, with funds allocated funds from the various sources of funds of the end user department, subject to the availability of funds and budgetary approval at the time of need. Section 3. The City Manager {1} is authorized to execute a supplemental agreement, in substantially the attached form, and to execute any amendments to the supplemental agreement, in a form acceptable to the City Attorney, for said purpose. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: VI-ORIA NDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon date stated herein, whichever is later.
