HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00326 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY ("COUNTY"), IN SUBSTANTIALLY THE ATTACHED FORM, PROVIDING THAT THE COUNTY OVERSEE THE DESIGN AND CONSTRUCTION OF A FENCE ALONG THE US 1 TRANSPORTATION CORRIDOR BETWEEN SOUTHWEST 24 AVENUE AND SOUTHWEST 27 AVENUE, MIAMI, FLORIDA, TO PROVIDE GREATER VISIBILITY OF LOCAL BUSINESSES LOCATED ALONG THE TRANSPORTATION CORRIDOR; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENTS AND TRANSPORTATION PROGRAM PROJECT NO. B-50416, US 1 FENCE DISTRICT 4; FURTHER PROVIDING THAT THE CITY OF MIAMI REIMBURSE THE COUNTY FOR THE ACTUAL BID AMOUNT ASSOCIATED WITH THE PROJECT, WHICH IS PRESENTLY ESTIMATED AT $50,000.00, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED SHOULD THE TOTAL PROJECT COST EXCEED $50,000.00. WHEREAS, the City of Miami ("City") desires to remove and replace the existing fence located along US 1 between Southwest 24 Avenue and Southwest 27 Avenue, Miami, Florida ("Metrorail Property") with a fence that is lower in height in order to provide for greater visibility of local businesses located adjacent to that portion of US 1 ("Project"); and WHEREAS, the City and Miami -Dade County ("County") desire to enter into an Interlocal Agreement ("Agreement"), in substantially the attached form, providing that the County oversee the design and construction of the fence along the Metrorail Property; and WHEREAS, the scope of work for the Project, known as the Capital Improvements and Transportation Program ("CITP") Project No. B-50416, US 1 Fence District 4, consists of the removalofthe-existing-fence and -the -design,--construction,-and-installation-of-a-new-fence-that-is lower in height than the existing fence ("Scope of Work"); and WHEREAS, the total cost of the Scope of Work is estimated at $50,000.00; and WHEREAS, the County shall retain ownership of the fence and be responsible for the maintenance, repair, and operation of the fence; and WHEREAS, Section 163.01, Florida Statutes, and the Miami -Dade County Home Rule Charter, as amended, permit the City and the County to enter into Interlocal Agreements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized {1} to execute an Agreement with the County, in substantially the attached form, providing that the County oversee the design and construction of a fence along the Metrorail Property, to provide greater visibility of local businesses located along the transportation corridor, with funds allocated from CITP Project No. B-50416, US 1 Fence District 4, and further providing that the City reimburse the County for the actual bid amount associated with the project, which is presently estimated to cost $50,000.00, subject to budgetary approval at the time of need should the total project cost exceed $50,000.00. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: 1 VIC? RIA MENbEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
