Alfonso DATE: City Manager FROM: Annie Perez, CPP Director Procurement Department SUBJECT: February 17, 2016 Approval of finding to waive competitive sealed bidding methods for Commercial Card Services (P-Card) REFERENCES: ENCLOSURES: The Procurement Department ("Procurement") submits this memorandum on your behalf. Procurement has determined that it is not practical and advantageous to the City to adhere to competitive sealed bidding methods for the provision of Commercial Card Services (P-Card) performed by JPMorgan Chase Bank, N.A., ("JPMorgan") and therefore seeks a waiver of such requirements for a period of twelve (12) months. When the Miami City Commission approved Resolution No. 15-00188, it authorized the City Manager to execute the First Amendment to the Participation Agreement with JPMorgan for a period of twelve (12) months (April 1, 2015 — March 31, 2016) to allow for continuity of services while re -procurement functions were completed. During the approved time period, it was the City's intent to issue a solicitation under full and open competition for the P-card and Banking Services. In consultation with the Finance Department it was determined that it is not in the City's best interest to procure both services under one solicitation. This waiver of the competitive process is recommended to allow sufficient time to finalize the re -procurement of the P-Card services and allow for a seamless implementation and transition. Through this waiver of the requirement for competitive sealed bids, a Second Amendment to the Participation Agreement would be executed for an additional twelve (12) month period (April 1, 2016 — March 31, 2017) with JPMorgan to allow for the unobstructed continuity of services while the City completes the re -procurement of services through its full and open competitive solicitation process, in addition to effectuating a seamless implementation and transition period with the new financial provider, if necessary. In support of the City's operational best interests at the present time, this request is being presented to waive the competitive process for the provision of P-Card services to JPMorgan Chase Bank, N.A. The estimated rebate to the City for the twelve (12) month period is $27,000 based on the volume of purchases made with the P-card. Pursuant to Section 18-85, as amended, it is respectfully recommended that you, as the City Manager, waive competitive sealed bidding methods via this written finding and reasons herein. Said waiver shall need to ratified, confirmed, and approved by the Miami City Commission by a four -fifths (4/5ths) affirmative vote during an advertised public hearing.
