HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00169 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, PURSUANT TO A SPECIAL WARRANTY DEED, THE DONATION OF A PARCEL OF LAND FROM PRH NE 31 ST STREET, LLC AND THIRTY-FIRST STREET PROPERTY OWNER LLC ("GRANTORS"), IDENTIFIED AS PORTIONS OF FOLIO NOS. 01-3230-012-0060 AND 01-3230-095-0001 LOCATED AT APPROXIMATELY NORTHEAST 32ND STREET AND NORTHEAST 7TH AVENUE MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), TO THE CITY OF MIAMI WITH THE GRANTORS PAYING FOR ALL COSTS ASSOCIATED WITH THE TRANSFER OF THE PROPERTY, INCLUDING BUT NOT LIMITED TO, THE SURVEY, ENVIRONMENTAL REPORT, TITLE INSURANCE AND CLOSING COSTS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO EFFECTUATE SAID CONVEYANCE. WHEREAS, PRH NE 31 st Street, LLC and Thirty -First Street Property Owner LLC ("Grantors") own the property identified as portions of Folio Nos. 01-3230-012-0060 and 01-3230-095-0001 located at approximately Northeast 32nd Street and Northeast 7th Avenue, Miami, Florida, as more particularly described in Exhibit "A" ("Property"); and WHEREAS, the Grantors intend to construct and develop a high-rise condominium, known as Paraiso Bay, with recreational amenities adjacent to the Property; and WHEREAS, the Grantors have voluntarily proffered the Property to the City of Miami ("City") to be solely used and enjoyed as a park; and WHEREAS, the Grantors have further agreed to maintain said park in perpetuity; and WHEREAS, the City's Department of Parks and Recreation recognizes the need for parks in the community and recommends the acceptance of the conveyance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized {1} to accept, pursuant to a Special Warranty Deed, in a form substantially similar to Exhibit "B", the donation of a parcel of land from the Grantors, identified as portions of Folio Nos. 01-3230-012-0060 and 01-3230-095-0001, as described in Exhibit "A", to the City, with the Grantors covering all costs associated with the transfer, including but not limited to, the survey, environmental report, title insurance and closing costs. The Grantors shall execute and record a covenant running with the land, in a form substantially similar to Exhibit "B", to require the Grantors to maintain the park in perpetuity. Section 4. The Grantors shall record the Special Warranty Deed and the covenant running with the land contemporaneously with the liana Plat. Section 5. The City Manager is further authorized {1} to execute any necessary documents, in a form acceptable to the City Attorney, in order to effectuate said conveyance. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CRRECTNESS: VI ORIA M NDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
