File ID 16-00163 Resolution No. 16-0093, adopted March 11, 2016, authorizing the Three (3) Party Escrow Agreement with the State of Florida Department of Transportation for the installation of nineteen (19) decorative light poles along State Road ("S.R.") 968/Southwest 1st Street, contained a scrivener's error that stated in the body of the Resolution that the City of Miami had jurisdiction over and maintained S.R. 968/Southwest 1st Street when it should have stated that the State of Florida Department of Transportation had such jurisdiction.. The scrivener's error was corrected in the Legistar file under version 2. Enclosure(s) a -43 CD w m m t:aCD 0 o - 001 q3 - Scitani2A aeib02. «LQiii o City of Miami Legislation Resolution: R-16-0093 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00163 Final Action Date:3/11/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A THREE (3) PARTY ESCROW AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("DEPARTMENT") AND THE STATE OF FLORIDA, DIVISION OF FINANCIAL SERVICES, DIVISION OF TREASURY, TRANSFERRING REQUIRED FUNDS FROM THE CITY OF MIAMI TO THE DEPARTMENT FOR THE INSTALLATION OF NINETEEN (19) DECORATIVE LIGHT POLES ALONG STATE ROAD 968/SOUTHWEST 1ST STREET FROM FLAGLER STREET TO SOUTHWEST 17TH AVENUE, MIAMI FLORIDA. WHEREAS, the State of Florida Department of Transportation ("Department") has jurisdiction over and maintains the State Road ("S.R.") 968/Southwest 1st Street corridor within the corporate limits of the City of Miami ("City"); and WHEREAS, the City has requested that the Department install, or cause to be installed, nineteen (19) decorative light poles along S.R. 968/Southwest 1st Street from Flagler Street to Southwest 17th Avenue, Miami, Florida ("Project"); and WHEREAS, the Department has agreed to complete, or cause to be completed, the Project subject to the terms and conditions detailed in the Three (3) Party Escrow Agreement ("Agreement"); and WHEREAS, the City shall fund the increased costs, under Financial Project No. 414633-2-52-02, associated with the Project, and as detailed in the attached Exhibit "A", "Scope of Services", which is herein incorporated by reference; and WHEREAS, the parties are authorized to enter into the Agreement pursuant to Sections 334.044(7) and 339.12, Florida Statutes, and to authorize their respective officers to do so; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the Agreement, in substantially the attached form, with the Department and the State of Florida, Division of Financial Services, Division of Treasury, transferring required funds from the City to the Department for the Project. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
