HomeMy WebLinkAboutR-16-0088City of Miami Legislation Resolution: R-16-0088 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16-00095 Final Action Date: 3/11/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT ("LEASE"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE GRAND CONDOMINIUM ASSOCIATION, INC. AND THE CITY OF MIAMI ("CITY") PROVIDING FOR THE PLACEMENT OF A MARITIME RADAR AND ASSOCIATED INSTRUMENTS ON THE PREMISES OF THE GRAND CONDOMINIUM, LOCATED AT 1717 NORTH BAYSHORE DRIVE, MIAMI, FLORIDA FOR USE BY THE CITY'S DEPARTMENT OF FIRE -RESCUE AT NO COST TO THE CITY, COMMENCING UPON EXECUTION OF THE LEASE BY THE CITY FOR A TERM OF FIVE (5) YEARS, UNLESS EARLIER TERMINATED PURSUANT TO THE PROVISIONS OF THE LEASE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID LEASE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the Grand Condominium Association, Inc. ("Lessor") governs and controls the common areas of the condominium known as the Grand Condominium located at 1717 North Bayshore Drive, Miami, Florida; and WHEREAS, the City of Miami ("City") Department of Fire -Rescue has a need to place a maritime radar and associated instruments ("Communication Equipment") on a building within the City limits; and WHEREAS, the Communication Equipment to be installed is part of the "South Florida Maritime Security System", an initiative funded by the Department of Homeland Security; and WHEREAS, the Lessor has space available on the rooftop of the Condominium building for installation of the Communication Equipment; and WHEREAS, this Lease Agreement ("Lease") would be at no cost to the City; and WHEREAS, the term of this Lease commences upon execution of the Lease by the City for a term of five (5) years, unless earlier terminated pursuant to the provisions of the Lease; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a Lease, in substantially the attached form, between the Grand Condominium Association, Inc. and the City providing for the placement of a City of Miami Page 1 of 2 File Id: 16-00095 (Version: 1) Printed On: 4/24/2018 File Number: 16-00095 Enactment Number: R-16-0088 maritime radar and associated instruments on the premises of the Grand Condominium, located at 1717 North Bayshore Drive, Miami, Florida for use by the City's Department of Fire -Rescue at no cost to the City, commencing upon execution of the Lease by the City for a term of five (5) years, unless earlier terminated pursuant to the provisions of the Lease. Section 3. The City Manager is further authorized {1} to negotiate and execute all other documents, including amendments and modifications to said Lease, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
