A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIET ZONE
IMPROVEMENT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") FOR THE
ALLAPATTAH QUIET ZONE PROJECT, CAPITAL IMPROVEMENT AND
TRANSPORTATION PROGRAM PROJECT NO. B70248; FURTHER ACCEPTING A
GRANT AWARD FROM FDOT IN AN AMOUNT NOT TO EXCEED $441,351.00,
ALLOCATED AND APPROPRIATED BY THIS RESOLUTION FOR THE
IMPLEMENTATION OF SAID PROJECT.
WHEREAS, the City of Miami ("City") applied for and was awarded a federal grant in the amount
of $441,351.00 from the Florida Department of Transportation ("FDOT") for the Allapattah Quiet Zone
Project, Capital Improvement and Transportation Program Project No. B70248 ("Project"), to construct
a federally compliant quiet zone along the CSX Downtown Spur Corridor within the Allapattah
neighborhood; and
WHEREAS, the scope of work consists of the design and construction of the Project, including
safety upgrades and improvements of nineteen (19) existing at -grade railing crossings located within
Allapattah; and
WHEREAS, this Resolution accepts FDOT funding, in the amount of $441,351.00, and seeks
authorization for the City Manager to execute the Quiet Zone Improvement Agreement ("Agreement"),
in substantially the attached form, in order to accept and administer the funds; and
WHEREAS, funds are to be allocated and appropriated by this Resolution for the implementation
of said Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute the Agreement, in substantially the
attached form, with FDOT, accepting a grant award from FDOT in the amount not to exceed
$441,351.00, for the implementation of the Project, allocated and appropriated by this Resolution.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
