For reference, we are only going to contract for phase 1 and the PO will only be opened for the phase 1 bid amount.
Any contingency use will be reviewed on an as -needed basis and PO increases if any will occur based on CITP approval
and budget availability.

ITB 13-14-027 Coconut Grove Waterfront Master Plan (Regatta Park) (B-30182B)
The Office of Management and Budget (OMB) has verified that the City has a reasonable expectation that sufficient
funding will be available for Phase I (demolition and construction) of the Regatta Park project (ITB 13-14-027 and 40B-
30182B).
There is currently $4.3 million allocated to and appropriated for this project in the FY 2014-15 Capital Budget. There is
an additional $2,252,389.23 recommended by the City Administration to be added to this project and appropriated
therefor on the February 12, 2015 Agenda (Item RE.9). This totals $6,552,389.23, which is more than the $6,137,000
proffered by the lowest bidder for Phase I, but is lower than the $6,750,000 of this bid plus a 10 percent contingency. At
this time, there is not enough funding available for Phases II or III.
Further, the expedite provision (City Code Section 18-117 Economic stimulus awards and agreements) as amended
requires that the contract amount be within 10 percent of the latest cost estimate which was calculated on December
22, 2014 at $7,518,791 by Kimley Horne and Associates as the City's Construction Consultant (for the Office of Capital
Improvements and Transportation Programs). If the contract is awarded to the lowest bidder (as OMB would expect),
the total contract amount will be $8,061,746 for all three phases, which is within this 10 percent requirement of the
aforementioned City Code.
State of Florida law states that, "The adopted budget must regulate expenditures of the municipality, and an officer of a
municipal government may not expend or contract for expenditures in any fiscal year except pursuant to the adopted
budget" (F.S. Section 166.241- Fiscal years, budgets, and budget amendments). Further, the City's Anti -Deficiency
Ordinance states, "Notwithstanding the adoption of an ordinance or resolution by the city commission expending funds,
any ordinance or resolution which exceeds an approved departmental or agency budget may be considered voidable
and shall be placed on the next regular city commission agenda by the city manager or executive director for budget
approval and adjustments as deemed appropriate" (City Code Section 18-502 - Anti -Deficiency - Procedures and
implementation).

OMB finds that sufficient funds will be available for Phase I of this project if Item RE.9 on the February 12, 2015
Agenda is adopted as approved. But, there are not sufficient funds for Phases II or III or for a 10 percent contingency
on Phase 1.
