paint booth and repair facility at 2700 NW 36 Street
Dear Mr. Cejas,
The undersigned is the authorized legal representative for Summit Aerospace,
tenant/operator at that Property in the City of Miami located at 2700 NW 36 Street ("Summit" or
"Applicant"). Summit files this application with the consent and authorization of Thomas
Campaniello, the owner of the subject property.
Summit Aerospace (a/k/a as Avionics International, AEG, Inc.) is a state of the art
company specializing in the repair and overhaul of aircraft components. The company has been
in operation in Miami since 1969. It currently has three facilities in Miami Dade County. The
facility at 2700 NW 36 Street is the avionics repair facility, where landing gear is overhauled,
maintained and/or repaired as well as where avionics are repaired or maintained. Avionics are
the electronic systems used on aircraft. This include communications, navigation, the display
and management of multiple systems, and the hundreds of systems that are fitted to aircraft to
perform individual functions. The landing gear repair service includes painting the equipment
in a paint booth.
On September 24, 2007, the City's Zoning Board adopted Resolution No. ZB-07-0087
approving a special exception to allow repair services and the paint booth as a conditional
principal use in the C-2 Liberal Commercial District, the Property's zoning at that time. A copy
of Res. ZB-07-0087 is included with this submittal.

The Special Exception was approved subject to the following:
This special exception was granted with a time limitation of twelve months in
which a building permit must be obtained, subject to the following conditions:
(1) a complete landscape plan, with specification depicting irrigation and
illumination for the parking area must be submitted for review and approval by
the Planning Department prior to the issuance of any building permit, and
2) a paint color samples and sign specification shall be submitted for review
and approval by the planning department prior to the issuance of any building
permit.
Enclosed is a copy of the landscaping plan prepared by Tectonic Associates date 2/11/08
and approved by the Planning Department on 04/28/08; a copy of the Building Department
permit list for the property confirming issuance of building permits for the improvements and
signage, and a letter dated July 19, 2012 from the Assistant Planning Director confirming that
"all conditions of the Special Exception were met and a building permit was issued on April
25, 2008 for the spray booth."
On or about March 20, 2015, while in the process of obtaining documents for the Miami
Dade County Division of Environmental Resources for the paint booth, Summit was first alerted
to the fact that a certificate of use for the paint booth and for the avionics repair operation was
necessary. A copy of the City of Miami Previous Business Usage inquiry history for the
property confirming that Summit commenced the CU process on March 20, 2015 is enclosed.
Also enclosed with this submittal are the Certificates of Use for Summit's building at 2700 NW
36 Street from the date the building peiniit for the repair area renovations and the paint booth
were finalized until the present dated. Summit had obtained a Special Exception approval for
these specific uses rom the City's Zoning Board and had also satisfied all the conditions,
including all permits, for these uses, Summit continued to rely on the approvals of the city,
including the letter from the Assistant Planning Director, that the uses are legal and may continue
to exist on the Property.
Notwithstanding all this evidence of permits and approvals, the Zoning Administrator
requested an opinion from the City Attorney's office concerning the effect of not having a
Certificate of Use for the paint booth and the repair services on Summit's ability to continue
these uses. On June 4, 2015, the City Attorney's office advised the Zoning Administrator that
"the paint booth and repair services uses are illegal and may not continue on the Property."
The City Attorney's analysis is based on the provisions of Miami 21 whereby non -conforming
uses may not continue under Miami 21, under Section 7.2.

We respectfully but vehemently disagree that the uses are illegal and in any way not
subject to the provisions of Section 7.2.1 of the Miami 21 Code that permit the continued
operation of legal non -conforming uses.
Miami 21, Section 7.2.1, defines a nonconformity as "an existing Use, ... that is in
compliance with the zoning regulations that were applicable to it when it was established and for
which all required permits were issued but which does not conform in whole or in part to the
regulations of this [Miami 21] Code. Such non -conformity is legal and may continue except as
regulated by this section." (emphasis added).
On July 23, 2015, after the date of the City Attorney's memorandum to the Zoning
Administrator, the City Commission adopted Ordinance 13539 (File No. 15-00761) an extension
of time for the Nonconforming Use Pilot Program for the renewal or reinstatement of certificates
of use for nonconforming uses. Without waiving our rights to appeal a future decision of the
Zoning Administrator denying the permits necessary to operate the repair and paint booth uses,
the Applicant hereby files an application for Special Exception pursuant to Section 2-212 (c) of
the City Code to permit the issuance of a certificate of use for a use that became non -conforming
upon the adoption of Miami 21.
In accordance with Section 2-212 (c) of the Code, we submit the following in support for
the Exception approval and in response to the criteria for approving the Exception:
(1) The nonconforming use was originally legally established and operated at the time
the use began. The use received a Special Exception approval from the City Zoning Board.
The conditions of the approval were approval of landscaping plan and signage plan and the
issuance of building permits. All the conditions of the Zoning Board's approval were met and
the Assistant Planning Director confirmed this, in writing, on July 19, 2012, well after the Miami
21 Code was in full effect.
(2) If [the non -conforming use is] in a structure, the nature and character of the
nonconforming use is substantially the same as that for which the structure was originally
designed. The facilities at Summit Aerospace are state of art, fully enclosed in air conditioned
facility that is pristinely clean and inspected on a regular basis by the US Armed Forces, the
Federal Aviation Department and State and local regulatory agencies. The operations meet all
of the regulatory standards for the industry. The Property is Zoned T6-8 0 and all the uses are
conducted within an enclosed, air conditioned office building.
(3) No material difference in the quality, character intensity or degree of the
nonconforming use will exist or greater compliance with the Miami 21 Code is provided; The
avionics repair operations are similar to a computer repair facility; the landing gear repair and
overhaul is conducted in a fully enclosed area with proper best management practices and the
paint booth has all the required permits and does create any hazardous or nuisance conditions.

(4) The nonconforming use will not prove materially adverse to the surrounding
properties pursuant to Article 4, Table 12, of the Miami 21 Code. The N. W. 36 Street corridor is,
unfortunately, a row of used car sales and car repair facilities that lack appropriate landscaping
and that conduct open lot car sales and open air body and mechanical repair. The properties to
the south are located within the jurisdiction of unincorporated Miami Dade County and include
scrap metal facility and other heavy industrial uses. The surrounding properties that are located
in Unincorporated Miami Dade County are zoned IU-1 (Light Industrial)- a zoning district
where all of Summit's uses are permitted, by right) Summit's operations at this facility as well
as their other locations are the standard for this type of operation.
Summit Aerospace is currently ranked number one in Florida for aerospace
manufacturing attractiveness and number one for aircraft manufacturing workforce. On
September 3 of this year, Governor Rick Scott and Lt. Governor Carlos Lopez Cantera gave the
Governor's Business Ambassador Award to the owners of Summit Aerospace. The company
employs more than 145 highly technical employees, most of which are home grown and trained
through the company's apprenticeships and training programs. Summit Aerospace is exactly the
type of business that the City should support and promote.
Summit has obtained all the permits and approvals required for their operations. When
Miami 21 was adopted, Summit had received the necessary Special Exception to conduct the
repair and paint booth uses and had received all the building permits associated with the same.
No condition of their approval required that they obtain a certificate of use for the paint booth or
for the repair operations.
We respectfully request the necessary approvals required for the issuance of certificates
of use for the repair services and the paint booth uses at Summit's building at 2700 NW 36
Street.
A check in the amount of $ 3,000 for the Zoning Referral fee is enclosed along with a
completed draft application, plans and a copy of the previous application. Should you have any
