BACKGROUND The subject site is located at 2700 Northwest 36 Street and is approximately .37 acres (16,135 square feet) in size. City Commission Exception Nonconforming Use Pilot File Id: 15-01653x 2700 NW 36 St. (Summit Aerospace) Page 2 Currently, the development on the site includes an existing two-story building constructed in 1985 and related surface parking. Summit Aerospace, Inc., (Avionics International, AEG, Inc.) has been operating on the site since July 7, 2005. The company provides avionics services (repair and maintenance of airplane components such as landing gear and electronics). The zoning for the site is T6-8-O (Urban Core -Open) under Miami 21 Zoning Code; previously it was zoned "C-2" (Liberal Commercial) under the 11000 Zoning Ordinance. Background Under the 11000 Zoning Ordinance, "automotive paint and repair services" were only permitted in the C-2 Zoning District with the approval of a Special Exception. As such, Summit Aerospace, Inc. submitted an application for a Special Exception in August of 2007, to allow repair services of avionics equipment and painting of such components within a paint booth proposed to be located inside the building. In September 2007, Summit Aerospace, Inc., received approval for a Special Exception to allow repair services of avionics equipment and a paint booth for said equipment. After complying with the conditions of approval and obtaining the proper building permits, Summit Aerospace, Inc. has been operating their avionics repair and paint booth inside the building on the site. However, in March of 2015, when the Summit Aerospace, Inc. attempted to obtain documents from the Miami -Dade County Division of Environmental Resources for the paint booth, they were informed that they needed a Certificate of Use for the paint booth and avionics repair operation. The Certificate of Use that was issued to them from the City of Miami, only indicated "General Commercial - Office" uses. No Certificate of Use was issued for the repair and paint booth uses, which makes those uses nonconforming. The applicant is now before the Commission to request that the nonconforming uses be reinstated per City Code, Chapter 2, Division 2, Section 2-212(c), which establishes a Nonconforming Use Pilot Program. While the applicant has obtained the necessary approvals, permits, and entitlements, the Certificate of Use required for the avionic repair and paint booth uses was not obtained. Zoning History On Monday, September 24, 2007, the City's Zoning Board heard the applicant's request for a Special Exception, as listed in Ordinance No. 11000, as amended the Zoning Ordinance of the of the City of Miami, Article 4, Section 401, Under Conditional Principal Uses of C-2 Liberal Commercial (4), to allow paint booth and repair services by Special Exception, for the property located at approximately 2700 Northwest 36 Street, Miami, Florida. The Special Exception was approved by the Board with 9-0 in favor of the request, with a time limitation of twelve (12) months in which a building permit must be obtained, subject to the following two conditions: 1) A complete landscape plan, with specification depicting irrigation and illumination for the parking area must be submitted for review and approval by the Planning Department prior to the issuance of any building permit; and City Commission Exception Nonconforming Use Pilot File rd: 15-01653x 2700 NW 36 St. (Summit Aerospace) Page 3 2) A paint color samples and sign specification shall be submitted for review and approval by the planning department prior to the issuance of any building permit. A complete landscape plan. City records indicate that the Summit Aerospace, Inc. complied with the above Conditions of Approval for the proposed uses. In addition, a letter was issued from the Planning Department dated July 19, 2012, which confirmed, "all conditions of the Special Exception were met and a building permit was issued on April 25, 2008 for the spray booth." When Summit Aerospace, Inc., approached the City of Miami's Zoning Administrator regarding a Certificate of Use for the paint booth and repair services permitted by Special Exception, the Zoning Administrator conferred with the Office of the City Attorney. The Office of the City Attorney sent the Zoning Administrator a memorandum dated June 4, 2015. The memo stated that while the applicant complied with the conditions of approval for the Special Exception, no Certificate of Use was issued for the repair and paint booth uses. As such, the repair and paint booth uses were non -conforming under the 11000 Code of Ordinances. The memorandum concluded as there was not a Certificate of Use under the 11000 Code and because Miami 21 does not allow avionic repair and paint booth uses, that the non -conforming uses were illegal and could not be continued per Miami 21, Article 7, Section 7.2 Nonconformities: Structures; Uses; Lots; Site Improvements; and Signs. As such, the applicant requests an Exception per Chapter 2, Division 2, Section 2-212(c) of the City Code, Nonconforming Use Pilot Program. As stated earlier, under the 11000 Zoning Ordinance the repair and paint booth uses were permitted with the approval of a Special Exception. However, with the adoption of Miami 21, the zoning of the site changed to T6-8-O, which does not allow auto -related industrial establishments (or similar), which allow repair, maintenance, paint and body work. Therefore, the current uses are nonconforming as they do not have an active Certificate of Use, and Article 7, Section 7.2.6 does not apply to reinstate the use. ANALYSIS Exception per Chapter 2, Division 2, Section 2-212(c) of the City Code, Nonconforming Use Pilot Program In the absence of a Certificate of Use for the avionics repair and paint booth uses, these uses were deemed nonconforming upon the adoption of Miami 21 in 2010. City Code, Chapter 2, Division 2, Section 2-212(c), establishes a Nonconforming Use Pilot Program in that, a Certificate of Use has lapsed or discontinued for a period of 18 months but less than five years, said nonconforming use may be reinstated through the process of Exception before the City Commission. City Commission Exception Nonconforming Use Pilot File Id: 15-01653x 2700 NW 36 St. (Summit Aerospace) Page 4 In this case, the applicant is petitioning to re-establish the avionics repair and paint booth use that was previously approved September 24, 2007 by a Special Exception. The Exception request to continue a nonconforming use complies with the criteria found in Chapter 2, Division 2, Section 2-212(c) of the City Code, Nonconforming Use Pilot Program. Specifically Section 2-212 (c), state that for a Certificate of Use that has lapsed or discontinued for a period of 18 months and less than five years, said nonconforming use could be reinstated should they go through City Commission through a process of Exception and compliance with specific criteria as follows: 1. The nonconforming use was originally legally established and operated at the time. The avionic repair and paint booth uses on this site were approved via Special Exception in September 2007, under the 11000 Zoning Code. Furthermore, it was confirmed via letter from the Planning Department on July 19, 2012, that the conditions of approval as stated for the uses on the site. The applicant also applied for and 2. If in a structure, the nature and character of the nonconforming use is substantially the same as that for which the structure was originally designed. The building contains office, avionics repair, and paint booth uses. The location of the paint booth inside the building is indicated on the building permits for the site. All uses are located within the structure and require specialized skills. 3. No material difference in the quality, character intensity or degree of the nonconforming use will exist or greater compliance with the Miami 21 Code is provided. As the avionics repair operations are conducted in a fully enclosed area with. The uses are required to comply with local and federal laws and inspections by the Federal Aviation Administration. 4. The nonconforming use will not prove materially adverse to the surrounding properties pursuant to Article 4, Table 12, of the Miami 21 Code. The uses in the area are mainly used car sales and car repair facilities. The properties south of the site are in unincorporated Miami -Dade County and include industrial uses. As such, these repair and paint booth uses has not been, nor will be materially adverse to surrounding properties and neighborhood context. In this case, the nonconforming uses (avionics repair and paint booth) were legally established with a public hearing and the nature and character of the nonconforming uses are substantially the same as that for which the structure was originally designed. There is no material difference in the quality, character, intensity, or degree of the nonconforming uses as requested. Lastly, the nonconforming use will not prove materially adverse to the surrounding properties RECOMMENDED ACTION The Summit Aerospace, inc. (Avionics International, AEG, Inc.) has applied for and received Certificate of Uses for the building since 2005. However, it appears that it was unclear to Summit Aerospace, inc., that a specific Certificate of Use was required for the avionics repair and paint booth uses, after approval of the Special Exception. City Commission Exception Nonconforming Use Pilot File Id: 15-01653x 2700 NW 36 St. (Summit Aerospace) Page 5 Staff recommends the approval of Exception for Summit Aerospace, Inc. to reestablish and operate the aviation repair facility and related paint booth uses. The requested Exception complies with the criteria and intent of the Nonconforming Use pilot program in Chapter 2, Section 2-212(c) of the City Code, which would allow the business' continuation. The operation of the aviation repair facility and paint booth uses were approved by Special Exception in approval September 24, 2007. Summit Aerospace, Inc. has provided proof of compliance with the required Conditions of Approval in 2008, and again via a letter from the City's Planning Department in 2012. Staff has reviewed the applicant's request and supporting documentation and supports the approval of the Exception under the Nonconforming Use Pilot Program, per Chapter 2, Division 2, Section 2-212(c) of the City Code. Staff recommends approval of the request subject to the following conditions: 1. The applicant or successor in interest shall comply with all applicable requirements all applicable departments/agencies as part of the City of Miami permitting process. 2. The Applicant shall meet the requirements of Chapter 24 of the Code of Miami -Dade County. 3. Failure to obtain a Certificate of Use for the avionics repair and paint booth will result in this use in being revoked. Attachments: A.
