A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ALLOCATION OF PROGRAM YEAR 2016-2017 HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM FUNDS, IN
THE PROJECTED AMOUNT OF $11,311,866.00, ALONG WITH $1,500,000.00 IN
HOPWA PROGRAM INCOME FUNDS FROM PREVIOUS YEARS, FORATOTAL
PROJECTED ALLOCATION OF $12,811,866.00 AS SPECIFIED IN ATTACHMENT
"A", ATTACHED AND INCORPORATED, TO PROVIDE HOUSING ASSISTANCE
AND HOUSING RELATED SERVICES TO LOW-INCOME INDIVIDUALS LIVING
WITH HIV/AIDS; AUTHORIZING THE ADJUSTMENT OF ALLOCATIONS IN DIRECT
PROPORTION TO THE ACTUAL ALLOCATION OF HOPWA FUNDS PROVIDED BY
UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR
THE 2016-2017 PROGRAM YEAR; AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
TO IMPLEMENT THE ALLOCATION OF SAID FUNDS.
WHEREAS, the Housing Opportunities for Persons with AIDS ("HOPWA") Program was created
under the AIDS Housing Opportunity Act and revised under the Housing and Community
Development Act of 1992; and
WHEREAS, since 1994, the City of Miami ("City") has received HOPWA Program funds from the
United States Department of Housing and Urban Development ("HUD") and has been responsible for
the implementation of programs designed to provide housing and related services to individuals living
with HIV/AIDS in the City and throughout Miami -Dade County ("County"); and
WHEREAS, HUD has yet to release the final Community Planning and Development Program
Formula Allocations for Program Year 2016; as such, the amount of HOPWA funds being
recommended is a projection; and
WHEREAS, from September 1, 2015 to October 1, 2015, the City solicited a request for proposal
from qualified agencies to provide housing assistance and housing related services to low-income
individuals living with HIV/AIDS in the City which resulted in the selection of the agencies being
recommended; and
WHEREAS, the City Administration recommends the allocation for Program Year 2016-2017
HOPWA Funds, in the projected amount of $11,311,866.00, along with $1,500,000.00 in HOPWA
Program Income funds from previous years, for a projected total allocation of $12,811,866.00 as
specified in Attachment "A", attached and incorporated, to provide housing assistance and housing
related services to low-income individuals living with HIV/AIDS;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The allocation for Program Year 2016-2017 HOPWA Program funds, in the projected
amount of $11,311,866.00, along with $1,500,000.00 in HOPWA Program Income funds from
previous years, for a projected total allocation of $12,811,866.00 as specified in Attachment "A",
attached and incorporated, to provide housing assistance and housing related services to low-income
individuals living with HIV/AIDS, is approved.
Section 3. The adjustment, by the City Administration, of allocations in direct proportion to the
actual allocation of HOPWA funds provided by HUD for the 2016-2017 program year, is authorized.
Section 4. The City Manager is authorized{1} to execute the necessary documents, in a form
acceptable to the City Attorney, to implement acceptance of said funds.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
