A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK
SCOTT AND THE FLORIDA DEPARTMENT OF STATE, VIA SECRETARY OF
STATE KEN DETZNER, TO HONOR THE INTERLOCALAGREEMENT ENTERED
ON FEBRUARY 7, 2008, IN ORDER TO MAINTAIN THE MIAMI CIRCLE PROJECT
TO THE STANDARDS ESTABLISHED IN THE INTERLOCALAGREEMENT,
THEREBY ENSURING THE MIAMI CIRCLE IS CLEAN AND FREE OF DEBRIS AND
GARBAGE AND INVITING TO THE PUBLIC; DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO THE INDIVIDUALS AS STATED
HEREIN.
WHEREAS, it is pivotal for the City of Miami to secure that public waterfront space remain clean
and free from debris and garbage; and
WHEREAS, the Florida Inland Navigation District ("FIND") serves as a body for continued
management and maintenance of the Atlantic Intracoastal Waterway project in Florida, which is a
state and federal project; and
WHEREAS, FIND and the Florida Department of State ("Department") entered into an Interlocal
Agreement ("Agreement") dated February 7, 2008, in which FIND provided the Department with grant
funding, to be used for the Miami Circle Shoreline Stabilization project ("Project"); and
WHEREAS, the Miami Circle is an archaeological site in Downtown Miami adjacent to the Miami
River, as well as a National Historic Landmark found within the Miami Circle Park; and
WHEREAS, Miami Circle Park serves as a waterfront park for residents and visitors of Miami;
and
WHEREAS, in accordance with the Agreement, the Department is responsible to maintain the
Project in agreement with reasonable standards of maintenance at a level comparable to other local
facilities in order to ensure applicable health standards, reasonable safety, reasonable repair,
prevention of undue deterioration and to encourage public use; and
WHEREAS, the Secretary of State at the time of the Agreement, in support of the Department's
application for grant funding of the Project, executed a Resolution on October 31, 2007 in which the
Department certified approval of the terms and conditions of the Project and Agreement; and
WHEREAS, furthermore the Resolution executed on October 31, 2007 stated the Department
would operate and maintain the Project at the expense of the Department for public use; and
WHEREAS, it has been stated that numerous attempts to resolve the poor conditions and lack of
maintenance at the Miami Circle have been made by FIND's Miami -Dade Commissioner and by the
Managing Director of the Miami River Commission to no avail;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to the Resolution are adopted
and incorporated as fully set forth in this Section.
Section 2. The City Commission urges Governor Rick Scott and the Florida Department of State,
via Secretary of State Ken Detzner, to honor the Agreement entered on February 7, 2008, in order to
maintain the Project to the standards established in the Agreement, thereby ensuring the Miami Circle
is clean and free of debris and garbage and inviting to the public.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Rick Scott
and to Florida Secretary of State Ken Dezner.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
