Gray Building 500 South Bronough Street Tallahassee, Florida 32399-0250 Re: Miami Circle Interlocal Agreement between Florida Department of State and Florida Inland Navigation District, Project Number: ICW-FDS-07-04 Dear Secretary Detzner: At the direction of the Board of Commissioners of the Florida Inland Navigation District ("FIND"), I am writing to request your assistance in resolving a problem that has arisen between our two agencies. As you may be aware, FIND and the Florida Department of State ("Department") entered into an Interlocal Agreement dated February 7, 2008 ("Agreement') pursuant to which FIND provided the Department with a grant of $548,808.86 to be used for the Miami Circle Shoreline Stabilization project ("Project'). Among the Department's responsibilities under the Agreement and the FIND rules incorporated therein by reference is the obligation to maintain the Project "in accordance with the standards and maintenance for other local facilities and in accordance with applicable health standards" and to keep the Project "reasonably safe and in reasonable repair to prevent undue deterioration and to encourage public use." See, Agreement, Section 6.d. and Rule 66B-1.004(6), Florida Administrative Code. The Secretary of State at that time also executed a Resolution dated October 31, 2007 in support of the Department's application for grant funding in which the Department certified to FIND "that it will accept the terms and conditions set forth in FIND Rule 66B-1, F.A.C. and which will be a part of the Project Agreement for any assistance awarded under the attached proposal" and "that the project will be operated and maintained at the expense of said Florida Department of State for public use [emphasis added]." In spite of numerous written and e-mail communications to the Department describing the deteriorating conditions and lack of maintenance of the Project, from both FIND's Miami -Dade County Commissioner and from the Managing Director of the Miami River Commission, the Department has failed to correct the situation. Prior to sending a Notice of Default pursuant to Section 9 of the Agreement, the Board of Commissioners desires to reach out to you as the agency head to make you aware of the problem and request your assistance. If this problem is not resolved, FIND may be forced to invoke the refund provisions in the Agreement. FIND considers this a last resort and we are hopeful that your intervention will make this drastic step unnecessary.
