FOR DOWNTOWN BEAUTIFICATION PROJECT — SOUTH (FLAGLER STREET) PROJECT B-30606 This Amendment No. 1 to the Contract dated May 7, 2015, (the "Contract") between the City of Miami, a municipal corporation of the State of Florida ("City"), and FHP Tectonics Corp., a Foreign profit corporation, for Downtown Beautification Project — South (Flagler Street), B- 30606 ("Project"), is entered into this day of , 2016. RECITALS WHEREAS, pursuant to Resolution No. R-14-0372, adopted September 29, 2014, the City Commission authorized the execution of a Contract with FHP Tectonics Corp. for the Downtown Beautification Project — South (Flagler Street), B-30606, in the amount of $8,852,205.60 for the scope of work, plus a ten percent (10%) owner contingency amount of $885,220.56, for a total not to exceed award value of $9,737,426.16; and WHEREAS, Plans revisions due to permit agency review required additional scope to be added to the Project; the revisions required design changes to the plans prior to construction start in January 2016; and WHEREAS, additional work in the amount of $835,820.62 is necessary to accommodate various design revisions to the Project plans and associated quantity adjustments; and Amendment No. 1 to the Contract increases the Contract by $835,820.62 for the scope of work, plus a ten percent (10%) owner construction contingency in the amount of $83,582.06, thereby increasing the award value from $9,737,426.16 to an amount not to exceed $10,656,828.84; NOW THEREFORE, for the considerations hereinafter set forth: The Contract is hereby amended as follows: 1. Section 2, Scope of Work is hereby amended to include the design revisions and associated quantity adjustments specified in Change Proposal Request No. 1. The additional work shall include the installation of ten (10) 24-inch steel well casing drainage wells at 100 feet depth and associated drainage well boxes, removal of abandoned 12-inch, 15-inch and 18-inch existing pipe, desilting pipe, connection of rainwater discharge flumes, installation of thermoplastic bicycle markings, miscellaneous quantity adjustments of adjacent work and the change of drainage culverts material from High Density Polyethylene Pipe to Reinforced Concrete Pipe; 1 2. The Contract Sum, as reflected in Bid Form, page 76, plus a ten percent (10%) contingency previously authorized by the City, is hereby increased by Nine Hundred Nineteen Thousand, Four Hundred Two Dollars and Sixty Eight Cents ($919,402.68), thereby increasing the total award value from Nine Million Seven Hundred Thirty Seven Thousand, Four Hundred Twenty Six Dollars and Sixteen Cents ($9,737,426.16), to an amount not to exceed Ten Million, Six Hundred Fifty Six Thousand, Eight Hundred Twenty Eight Dollars and Eighty Four Cents ($10,656,828.84). 3. The Contract Time, as reflected in Section 3 — Supplemental Terms and Conditions, paragraph 1, Contract Time and Hours, is hereby increased by Two Hundred Sixteen (216) Calendar Days, thereby increasing the Contract Time from Six Hundred Sixty (660) Calendar Days to Eight Hundred Seventy Six (876) Calendar Days. 4. This construction Contract increase does not include any administration "soft" costs. 5. All other terms and conditions of the Contract are in effect and remain unchanged.
