HomeMy WebLinkAboutO-13579City of Miami Legislation Ordinance: 13579 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01389 Final Action Date: 12/10/2015 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE I/SECTION 54-6.3 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/IN GENERAL/SPECIAL EVENTS", TO INCLUDE A PROCEDURE TO CALCULATE FEES FOR SPECIAL EVENTS OF LESS THAN TWENTY-FOUR (24) HOUR DURATION FOR THE USE OF THE PUBLIC RIGHT-OF-WAY; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the City of Miami and its inhabitants to amend the Code of the City of Miami, Florida, as amended, ("City Code") to include a procedure to calculate fees for special events of less than twenty-four (24) hour duration for use of the public right-of-way; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article I/Section 54-6.3 of the City Code, entitled "Streets and Sidewalks/In General/Special Events", is amended in the following particulars:{1} "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE I. IN GENERAL Sec. 54-6.3. Special events. (g) Fees. A fee of $0.25 per day per linear foot of street obstructed by the special event shall accompany each permit application to the department of public works for the use of the public right-of-way. The linear footage shall be calculated by the department of public works utilizing the city's officially established monument lines. The Director of the Department of Public Works shall have the authority to prorate the fee on an hourly basis for special events of less than twenty-four (24) hour total duration. If any section, part of a section, paragraph, clause, phrase or word of the Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately after final reading and adoption thereof.{2} Footnotes: {1} Words and /or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission.
