A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
PROPERTY ACCESS AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE UNITED STATES DEPARTMENT OF VETERANS AFFAIRS
("VETERANS ADMINISTRATION") GRANTING TO THE VETERANS
ADMINISTRATION TEMPORARY ACCESS RIGHTS TO CERTAIN CITY OF MIAMI
("CITY") OWNED REAL PROPERTIES LOCATED AT APPROXIMATELY 1765
NORTHWEST 15TH AVENUE, MIAMI, FLORIDA, AS SET FORTH IN COMPOSITE
EXHIBIT "A", FOR THE PURPOSE OF PERFORMING NECESSARY DUE
DILIGENCE ACTIVITIES ON THE PROPERTIES WITHOUT ANY FEES, COSTS, OR
EXPENSES TO THE CITY.
WHEREAS, the City of Miami, Florida ("City") is the owner of certain real property, consisting of
two (2) parcels of raw land with Folio numbers 01-3135-087-0010 and 01-3135-087-0012 totaling
approximately 0.97 acres of land located at approximately 1765 Northwest 15th Avenue, Miami,
Florida (collectively, "Properties") and further identified in Composite Exhibit A, attached and
incorporated; and
WHEREAS, pursuant to 42 United States Code Section 4651 ("Uniform Relocation Act") and
Section 29(B)(c) of the Charter of the City of Miami, as amended ("City Charter"), the Veterans
Administration (1) has previously purchased from the City at fair market value the adjacent property
formerly known as the Wagner Square Property and (2) now desires to appraise and perform
necessary environmental and other due diligence on the Properties in order to negotiate a purchase
and sale agreement for the Properties from the City to the Veterans Administration; and
WHEREAS, in order for the Veterans Administration to undertake the necessary appraisals,
environmental, and other due diligence as required by both Federal law and the City Charter, it is in
the best interests of the City to enter into a Property Access Agreement, in a form acceptable to the
City Attorney, with the Veterans Administration at no fees, costs, or expenses to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1 } to negotiate and execute a Property Access
Agreement, in a form acceptable to the City Attorney, with the Veterans Administration granting to the
Veterans Administration temporary access rights to certain City -owned real properties located at
approximately 1765 Northwest 15th Avenue, Miami, Florida, as set forth in Composite Exhibit "A", for
the purpose of performing necessary due diligence activities on the Properties without any fees,
costs, or expenses to the City.

Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
