This communication comes to you with reference to the September 10, Commission Hearing. There was a continuation of the July 23, 2015 Legislation Ordinance: Agenda#19, file number: 14-01075zt. All in all, that evening, with discussions within the commission hall with the public that was there to comment, property stakeholders, Victoria with the City Attorney office and Francisco with the City, it was pretty clear the language in version five was only missing three words not objected to at prior hearings. Within the first sentence of 7.2.8(b) omit the comma after Adaptive use, then add, or existing use. (see page three) That about does it! The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. No modifications may be permitted which increase the degree of the existing nonconformity. Modifications to Off-street Parking the fasil+ties may be approved by Waiver, and the Waiver may be conditioned on safeguards that reduce the degree of nonconformity to the extent reasonably feasible in the circumstances of the case. Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. It is the intention of the City Commission that the provisions of this Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami, Florida, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section," "article," or other appropriate word to accomplish such intention. Section 5. Dear Mr. Garcia, Please accept this Letter on behalf of the Downtown Little Haiti Stakeholders, Inc. We greatly appreciate the work that yourself and the administration has put into the language regarding the enabling of adaptive reuses for non -conforming structures and parking requirements. That being said, we believe there is a slight loophole regarding "Existing Uses" in these structures that may happen to be non- conforming. Therefore we are strongly in favor of a slight revision of the wording on the item regarding vested rights for Non Conforming Uses agenda item PZ 5 by simply adding "or Existing Uses". In order to protect the current owners and tenants City Wide from Iosing their Certificate of Uses due to a statute that leaves open the possibility of an interpretation that could jeopardize thousands of long standing tenants and to protect the future practice of sound planning and neighborhood revitalization please revise the language to the following: 7.2.8 NONCONFORMING SITE IMPROVEMENTS -14 b.
