HomeMy WebLinkAboutAttachment 1ATTACHMENT 1 THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF MIAMI-DADE, STATE OF FLORIDA, AND IS DESCRIBED AS FOLLOWS: A tract of land in the N.W. Y4 of Section 28, Township 54 South, Range 41 East, Miarni-Dade County, Florida, being in the Eastern part of the N1/2 of Lot "M", EWANTON HEIGHTS , Plat Book B, Page 52, of the Public Records of Miami - Dade County, Florida, more particularly described as follows: Commence at the division line between the N1/2 and S1/2 of Subdivision of Part of Lot M EWANTON HEIGHTS Dade County Florida, Plat Book 2, Page 33 of the Public Records of Miami -Dade County, Florida, at a point 1,062.8 feet from the Southwest corner of the N1/2 of said Lot "M", which said southwest corner is 723.7 feet south of northwest comer of said Section 28, Township 54 South, Range 41 East; thence South 57 degrees East 1,120 feet more or less, along said division line to the high water mark of the Westerly shore of Biscayne Bay; thence Northerly meandering along the high water mark line of Biscayne Bay to a point on the South line of ST, Gauden's Road, formerly known as Ozone Avenue, as said road was located by that certain Deed and release dated July 19, 1898, filed September 27, 1898, Deed Book "U", Page 236; said point being 13 feet, more or less, Southerly from the South line of said Ozone Avenue, as per aforesaid map of EWANTON HEIGHTS; thence Northwesterly along south line of St. Gauden's Road, for a distance of 1,140 feet more or less, to a point on the North line of Lot "M", which point is 1,197 feet from the Northwest corner of Lot "M", thence South 33 degrees West for 206.4 feet more or less, to the POINT OF BEGINNING of the tract of land herein described, together with all common law and statutory riparian rights appurtenant thereto. Less the following described tract of land: Commence at the division line between the N1/2 and the S1/2 of Subdivision of part of Lot M EWANTON HEIGHTS, Dade County, Florida, Plat Book 2, Page 33, at a point 1,062.8 feet from the Southwest corner of N1/2 of Lot "M", which said Southwest corner is 723.7 feet South of the Northwest corner of said Section 28, Township 54 South, Range 41 East; thence South 57 degrees East along said division line of 242,66 feet to a point; said point being the most Southerly corner of Lot 3, Philbrick Estates, Plat Book 61, Page18; thence North 33 degrees East more or less, along the Southeasterly boundary of said Lot 3, Philbrick Estates, for 40 feet to the beginning of a tangential circular curve; thence Northerly and Northeasterly along the Southeasterly boundary of Lots 3 and 4, of said Philbrick Estates, and along said curve having a radius of 25 feet through a central angle of 52 degrees 31 minutes 00 seconds for an arc distance of 22,91 feet to a point; thence North 33 degrees East, more or less, along the Southeasterly boundary of said Lot 4, Philbrick Estates, 147,30 feet to Northeasterly boundary of said Lot "M" and the South line of St, Gauden's Road; thence North 57 degrees West along the North boundary of said Lot "M" and along the South line of St. Gauden's Road to a point on the North boundary of Lot "M" and on the South line of St. Gauden's Road, which point is 1,197 feet from the Northwest comer of Lot "M" thence South 33 degrees West more or less, for 206.4 feet more or less, to the POINT OF BEGINNING. Subject to any and all rights of the City of Miami in and to a certain parcel of land on the Southerly side of the North line of said Lot "M", dedicated for use as part of that 50 feet avenue which runs along the Northerly boundary of said Lot "M" per Deed Book 14, Page 266. Also: A parcel of submerged land in Biscayne Bay in Section 28, Township 54 South, Range 41 East, more particularly described as follows: Beginning at the intersection of the Northeasterly line of Lot "M", EWANTON HEIGHTS, Plat Book B, Page 52, of the Public Records of Miami -Dade County, Florida, with the high water mark of Biscayne Bay, said point also being the intersection of the high water mark of Biscayne Bay with the Southwesterly right- of-way line of St. Gauden's Road, as same is shown on the Justison and Frantz Subdivision, Plat Book 6, Page 20, of the Public Records of Miami -Dade County, Florida; thence South 59 degrees 10 minutes 39 seconds East along the prolongation Southeasterly of the North line of the said Lot "M" for a distance of 183 feet more or less, to the intersection thereof with the bulkhead line as established for this area; thence South 40 degrees 6 minutes 46 seconds West along the said bulkhead line for a distance of 209,86 feet to the intersection thereof with the prolongation Southeasterly of the Northeasterly boundary line of the private path which is located along the Northeasterly boundary of Subdivision of Part of Lot M, EWANTON HEIGHTS Dade County Florida, Plat Book 2, Page 33, of the Public Records of Miami -Dade County, Florida; thence North 59 degrees 10 minutes 39 seconds West along the prolongation Southeasterly of the Northeasterly boundary of the said private path for a distance of 195 feet more or less, to the intersection thereof with the high tide line of Biscayne Bay; thence Northeasterly meandering the high water mark of Biscayne Bay, 214 feet more or less, to the POINT OF BEGINNING. Subject to reservation by the Trustees of the Internal Improvement Fund of the State of Florida, in deed dated June 15, 1961, and filed July 12, 1961, in Official Records Book 2714, Page 576, Clerk's File No. 118574, of the Public Records of Miami -Dade County, Florida, of title to an undivided 3/4 of all phosphate, minerals, metals, and title to an undivided 1/2 of all petroleum that may be in, on or under the above described land, with the privileged to mine and develop the same.
