HomeMy WebLinkAboutExhibitCERTIFICATION AND DECLARATION OF RESULTS FOR THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 3, 2015 STATE OF FLORIDA ) MIAMI-DADE COUNTY ) CITY OF MIAMI ) I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps were taken in connection with the conduct of a City of Miami General Municipal Election held on November 3, 2015, including, though not limited to, the following: I. On Thursday, October 15, 2015: A. Commencing at approximately 4:00 p.m. the Miami -Dade County Supervisor of Elections conducted a logic and accuracy test of the touch screen and optical scan voting systems to be used for absentee, early voting and precinct ballots for the candidates to be voted upon at the November 3, 2015 General Municipal Election. B. A member from the City of Miami's Canvassing Board compared the test results with the predetermined totals for each candidate and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment. IL On Friday, October 30, 2015 through Tuesday, November 3, 2015: A. On Friday, October 30, 2015, the Miami -Dade County Supervisor of Elections conducted the pre -count logic and accuracy test of the optical scan system used for absentee and provisional ballots. Additionally, the process of opening absentee ballots and the duplication of ballots (as needed) began at 10:00 a.m. The task of opening absentee ballots was continued on an as needed basis until Tuesday, November 3, 2015. III. On Tuesday, November 3, 2015 through Friday, November 6, 2015: A. On Tuesday, November 3, 2015, at 6:00 p.m., the City of Miami's Canvassing Board met to canvass presumed invalid absentee ballots. After the completion of this task, the tabulation of election results was finalized and the Miami - Dade County Supervisor of Elections presented me with the UNOFFICIAL election results for the November 3, 2015 General Municipal Election. Per 1 Section 101.048(1), Florida Statutes, persons casting provisional ballots have the right to present written evidence supporting his or her eligibility to vote to the Supervisor of Elections by no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 5, 2015. On Friday, November 6, 2015, provisional ballots were canvassed by the City of Miami's Canvassing Board. After the canvassing of provisional ballots was completed, I received the certified OFFICIAL election results for the November 3, 2015 General Municipal Election. IV. I further certify that on Thursday, October 15, 2015, two (2) sets of documents containing all of the results of the Logic and Accuracy Tests validated that the tabulating equipment was functioning correctly and that said documents were signed off by the Miami -Dade County Supervisor of Elections and City Clerk. These documents were then placed in a sealed canvass bag under seal number 0051719. On Friday, November 6, 2015, the sealed canvass bag was opened and one (1) set of documents was retained by the Supervisor of Elections and the other set retained by the City Clerk. V. I further certify and declare that: • for District 1 Commissioner, Wifredo "Willy" Gort received more than 50 percent plus one of all votes cast and is hereby declared to have been elected as Miami City Commissioner for District 1; • for District 2 Commissioner, no candidate received a majority of votes cast and therefore a Runoff Election will be required to determine who will be elected to the District 2 seat. Per City of Miami Charter Section 4(b), Ken Russell and Teresa Sarnoff, having received the greatest number of votes cast in the General Municipal Election, shall be placed on the ballot for the Runoff Election scheduled for November 17, 2015; • for District 4 Commissioner, Francis X. Suarez ran unopposed. Pursuant to Section 101.151(7), Florida Statutes, "...the names of unopposed candidates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself or herself." Additionally, per Miami City Code Section 16-8, "[i]f, at the close of the qualifying period there is only one candidate's name listed on the general municipal election ballot for mayor or for a city commissioner for a specific district seat(s), no election for mayor or for a city commissioner for a specific district seat(s) shall be required, and said candidate or candidates shall be declared elected for that particular term(s) of office as of five days after the date of the scheduled general municipal election." In accordance with Florida State Statutes and the Miami City Code, Francis X. Suarez is hereby declared to have been elected as Miami City Commissioner for District 4. 3 VI IL On Friday, November 6, 2015: A. At approximately 11:30 a.m. the Miami -Dade County Supervisor of Elections conducted a post -election manual audit at the Elections Department located at 2700 NW 87th Ave according to Florida Division of Elections Rule 1S-5.026. The audit entailed audit teams from the Elections Department manually counting the ballots cast by absentee voting, early voting and Election Day voting, for a randomly selected precinct within a randomly selected race. At the completion of the audit on Friday, November 6, 2015, I received the voting system post -election audit report.
