HomeMy WebLinkAboutR-15-0494City of Miami Legislation Resolution: R-15-0494 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01486 Final Action Date: 11/19/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY THE CITY OF MIAMI ("CITY") GENERAL EMPLOYEES' & SANITATION EMPLOYEES' RETIREMENT TRUST ("GESE") ON BEHALF OF MANUEL MEJIDO WITHOUT ADMISSION OF LIABILITY, THE AGGREGATE TOTAL SUM OF UP TO FIFTY THOUSAND DOLLARS ($50,000.00) AS FULL AND COMPLETE SETTLEMENT OF ANY AND ALL CLAIMS AND DEMANDS, INCLUDING ALL CLAIMS FOR ATTORNEY'S FEES AND COSTS, AGAINST THE CITY, ITS OFFICERS, AGENTS AND EMPLOYEES, IN THE CASE STYLED MANUEL MEJIDO VS. CITY OF MIAMI, PENDING BEFORE THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION, MIAMI DISTRICT OFFICE, CASE NO.: 846-2015-20995 UPON THE EXECUTION OF GENERAL RELEASES OF ALL CLAIMS AND DEMANDS, AND A WITHDRAWAL OF THE PLAINTIFF'S CHARGE AGAINST THE CITY; ALLOCATING FUNDS FROM THE NON -DEPARTMENTAL ACCOUNT NO. 00001.980000.531010.0000.00000. WHEREAS, Manuel Mejido has filed a charge of discrimination with United States Equal Employment Opportunity Commission Miami -District Office, case no.: 846-2015-20995; and WHEREAS, the Office of the City Attorney has investigated all Mr. Mejido's claims pursuant to Sections 18-221 through 18-232 of the Code of the City of Miami, Florida, as amended, and recommends that Mr. Mejido's claim be settled for a sum up to fifty thousand dollars ($50,000.00) paid on behalf of Mr. Mejido to the City of Miami General Employees' & Sanitation Employees' Retirement Trust ("GESE"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The Director of Finance is authorized{1} to pay GESE on behalf of Manuel Mejido without admission of liability, up to the aggregate total sum of fifty thousand dollars ($50,000.00) as full and complete settlement of any and all claims and demands, including all claims for attorney's fees and costs, against the City of Miami, its officers, agents and employees, in the claim styled as Manuel Mejido vs. City of Miami, pending before the United States Equal Employment Opportunity Commission in the Miami District Office, Case No.: 846-2015-20995 upon the execution of general releases of all claims and demands, and a withdrawal of the plaintiff's charge against the city of Miami; allocating funds from the Non -Departmental Account No. 00001.980000.531010.0000.00000. Section 3.
