A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING A PERPETUAL GRANT OF EASEMENT FROM THE GREATER MIAMI
BOYS' CLUBS FOUNDATION, INC. FOR PROPERTY ABUTTING A PORTION OF
SOUTHWEST 31STAVENUE, MIAMI, FLORIDA FOR SIDEWALK PURPOSES;
AUTHORIZING THE CITY MANAGER TO EXECUTE SAID PERPETUAL GRANT OF
EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, ON BEHALF OF THE
CITY OF MIAMI.
WHEREAS, on February 4, 2015, the Planning, Zoning and Appeals Board ("PZAB") adopted
Resolution No. PZAB-R-15-006 approving an Exception to allow the expansion of the Mater Grove
Academy located on the Greater Miami Boys' Clubs Foundation, Inc. ("Boys' Clubs Foundation")
property at 2805 Southwest 32nd Avenue, Miami, Florida; and
WHEREAS, through careful review and consultation, consultants for the Boys' Clubs Foundation,
the City of Miami ("City") Public Works Department, the City's Capital Improvements and
Transportation Program, and the Miami -Dade County Public Works, Traffic Engineering Division, have
determined that the optimum location for the school's bus drop-off area is near the Southeast corner of
the Boys' Clubs Foundation's property along Southwest 31 st Avenue; and
WHEREAS, the public right-of-way along Southwest 31st Avenue along the proposed drop-off area
is not wide enough to accommodate an adequate bus lane, and the required traffic lane and sidewalk
area; and
WHEREAS, the Perpetual Grant of Easement will provide the additional six (6) inches on the Boys
Clubs' Foundation's property to accommodate the proposed bus lane, while also providing the required
traffic lane and sidewalk area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Perpetual Grant of Easement from the Boys' Clubs Foundation for property
abutting a portion of Southwest 31 st Avenue, Miami, Florida for sidewalk purposes, is accepted.
Section 3. The City Manager is authorized{1} to execute said Perpetual Grant of Easement, in
substantially the attached form, on behalf of the City.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
