HomeMy WebLinkAboutR-15-0485City of Miami Legislation Resolution: R-15-0485 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01344 Final Action Date: 11/19/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND MIAMI-DADE COUNTY, TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF ROBBERY INTERVENTION INVESTIGATIONS WITH THE MIAMI-DADE COUNTY POLICE DEPARTMENT'S ROBBERY INTERVENTION DETAIL TASK FORCE, PURSUANT TO THE FLORIDA MUTUAL AID ACT, SECTION 23, FLORIDA STATUTES, TO APPREHEND AND PROSECUTE CRIMINALS ENGAGING IN VIOLENT CRIMES, INCLUDING ROBBERIES, THAT CROSS JURISDICTIONAL BOUNDARIES. WHEREAS, the City of Miami ("City") and Miami -Dade County ("County") have the authority under the Florida Mutual Aid Act, Section 23.12, et. seq., Florida Statutes, to enter into a Mutual Aid Agreement ("Agreement"); and WHEREAS, the City and the County recognize that criminals engaging in violent crimes do not operate with regard to jurisdictional boundaries; and WHEREAS, the purpose of this Agreement is to allow the City to assist the County's Police Department's Robbery Intervention Detail task force, created to investigate, apprehend, and prosecute persons committing robberies or other violent crimes, outside the jurisdictional boundaries of the City; and WHEREAS, pursuant to the Florida Interlocal Cooperation Act of 1969, Section 163.01, Florida Statutes, the City and the County have the authority to enter into agreements to jointly exercise any power, privilege, or authority which they share in common and which each might exercise separately; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a mutual aid agreement, in substantially the attached form, between the City and the County, to receive and extend mutual aid in the form of robbery investigations with the County's Police Department's Robbery Intervention Detail task force pursuant to the Florida Mutual Aid Act, Section 23, Florida Statutes, to apprehend and prosecute criminals engaging in the violent crimes, including robberies, that cross jurisdictional boundaries. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
