GENERAL INFORMATION: REQUEST: Pursuant to Article 3, Section 3.9, and Article 7, Section 7.1.2.8, of Ordinance 13114, as amended, the applicant is requesting a Special Area Plan (SAP) that will modify the existing transect zone regulations for the subject parcels to the extent indicated herein, and proposes a change to the Future Land Use Map (FLUM) for a density increase. This Special Area Plan (SAP) proposes a mix of commercial, office, residential, lodging uses and associated parking areas in addition to public plazas, and a public river walk promenade as follows: 1. The Miami River SAP is composed of approximately 10.2 acres of abutting properties. 2. The proposal is to construct approximately 4,181,087 square feet of development consisting of 1,678 residential units, 330 lodging units, 66,541 sq. ft. of office space and 176,350 sq. ft. of commercial space, 2,376 parking spaces, 35,694 sq. ft. of civic space and 15,175 sq. ft. of open space. B. BACKGROUND: The applicant owns approximately 6.2 acres of land located at 257 SW 7th Street, 233 SW 7th Street, 244 SW 6th Street, 635 SW 3rd Avenue, 224 SW 6th Street, 220 SW 6th Street, 501 SW 3rd Avenue, 645 SW 3rd Avenue, 252 SW 6th Street, 401 SW 3rd Avenue, 253 SW 7th Street, 219 SW 7th Street, 275 SW 6th Street, 2061 SW 6th Street, 201 SW 6th Street and 243 SW 6" Street. These parcels are located within the Riverside waterfront and the City of Miami South Plat, specifically located within the bounds of the Miami River to the north, SW 7th Street to the south, SW 2nd Avenue to the east and SW 3rd Avenue to the west. The City of Miami (co -applicant) owns Jose Marti Park, which is adjacent to the applicant's 6.2 acres. Four (4) acres of the park are encompassed within the SAP from northwest of SW 3rd Avenue, extending NW of the Miami River terminating at SW 2nd Street, for a combined acreage of 10.2 acres. 15-00624ap Miami River SAP Page 1 of 10 The site contains multiple unoccupied structures, including a former entertainment complex and nightclub, warehouses, two vacant parcels, adult book store, and multiple residential structures fronting SW 3rd Avenue. Additionally, there are two single-family homes within the site; one located at 645 SW 3rd Avenue and the second located at 635 SW 3rd Avenue. Although the homes were constructed in 1925 and 1930, they are not designated historic. However, as the homes are located within a high probability archeological zone, the applicant is required to obtain a certificate to dig. The site also contain multiple mature oak trees. C. COMPREHENSIVE PLAN: The requested density increase proposed in Exhibit B, establishing the "Miami River Residential Density Area", is inconsistent with the current Miami Comprehensive Neighborhood Plan (MCNP) designation. However, the existing character and density of the surrounding area is consistent with the proposed modifications to the Comprehensive Plan. To address the inconsistency, staff has submitted a companion item under 15-00354ct with this request to amend the land use designations for said parcels to allow a new Residential Density Increase Area (RDIA) to increase density from 200 D.U. to 400 D.U. per acre. D. The Background section of this report is hereby incorporated into the analysis and its corresponding criteria by reference: Purpose: The purpose of a Special Area Plan is to allow parcels greater than nine (9) Abutting acres in size to be master planned so as to allow greater integration of public improvements and Infrastructure, and greater flexibility so as to result in higher or specialized quality building and Streetscape design within the Special Area Plan. The purpose of a Special Area Plan further is to encourage the assembly and master planning of parcels greater than nine (9) Abutting acres in size, in order to provide greater integration of public and private improvements and Infrastructure; to enable Thoroughfare connectivity; to encourage a variety of Building Heights, massing and Streetscape design, and to provide high quality design elements, all in order to further the intent of this Code expressed in Article 2. Criteria a: The single or multiple owner(s) of Abutting properties in excess of nine (9) acres may apply for a rezoning to a Special Area Plan. Analysis: The proposed Special Area Plan consist of 10.2 acres. Findings: Consistent Criteria b: A Special Area Plan shall be approved by the process of rezoning with or without Transect changes. Analysis: The Miami River SAP will not modify the Transect Zones of the subject property. However, some of transect zone regulations applicable to the subject parcels will be modified 15-00624ap Miami River SAP Page 3 of 10 through the Regulating Plan. Where a section is not specifically modified, the regulations and the restrictions of the Miami 21 shall apply. Findings: Consistent Criteria c: A Special Area Plan shall assign Thoroughfares, Transect Zones and Civic Space Types, with appropriate transitions to Abutting areas. Guidelines for Thoroughfares and Public Frontages may be adjusted to the particular circumstances of the Special Area Plan. Analysis: The Miami River SAP assigns Thoroughfares and Civic space types with appropriate transitions to abutting areas as illustrated in the plans submitted. In addition, design elements such as pavers, street furniture, and landscaping are provided beyond the limits of the SAP thus further integrating the abutting areas through said design elements. Findings: Consistent Criteria d: A Special Area Plan shall include a map of the Thoroughfares and Transect Zones, and the standards that deviate from the requirements of Article 5. Analysis: The "Miami River SAP" includes a map of Thoroughfares and Transect Zones and a regulating plan and has been found to be in compliance with criteria "d". Findings: Consistent Criteria e: A Special Area Plan shall assign at least five percent (5%) of its aggregated Lot Area to a Civic Space Type. Civic Building sites are to be located within or adjacent to Civic Space Types or at the axial termination of significant Thoroughfares. The developer shall be responsible for constructing the public improvements within the Special Area Plan, including but not limited to the Civic Space Types and Thoroughfares. Analysis: The Miami River Special Area Plan assigned 35,694 sq. ft. (eight percent) of the aggregate Lot Area towards Civic Space as per Sheet B-12 of the plans submitted, entitled "Miami River Special Area Plan. Findings: Consistent Criteria f: Development within the Special Area Plan shall be pursuant to a recorded development agreement that will establish the allocation of Thoroughfares and Civic Space Types and Building Area among the Building sites, and the creation and retention of the public benefits. Analysis: A development agreement between the applicant and the City of Miami has been submitted in accordance with the above criteria and will be considered by the City Commission. Findings: Consistent 15-00624ap Miami River SAP Page 4 of 10 Criteria g: Unless a Building is specifically approved as part of the Special Area Plan, any Building shall be reviewed by the Planning Director, after referral to and recommendation from the CRC for conformance to the Plan, prior to issuance of the Building Permit. Analysis: CRC reviewed the Miami River SAP on March 13, 2015 and provided a series of comments which have been subsequently addressed by the applicant. The Miami River SAP is governed by a set of plans entitled "Miami River SAP as prepared by Kobi Karp, Roman and Williams, Kimley Horn, Raymond Jungles, and Coastal Systems International, consisting of 156 pages dated, stamped, and received by Hearing Boards on April 28, 2015. Findings: Consistent Criteria h: A Special Area Plan may include: 1. A differentiation of the Thoroughfares as a Primary -Grid (A -Grid) and a Secondary - Grid (B-Grid). Buildings along the A -Grid shall be held to the highest standard of this Code in support of pedestrian activity. Buildings along the B-Grid may be more readily considered for automobile -oriented standards allowing surface parking lots, unlined parking decks, and drive-throughs. The Frontages assigned to the B-Grid shall not exceed thirty percent (30%) of the total length within a Special Area Plan. For Frontages on the B-Grid, parking areas may be allowed in the Second Layer. Analysis: A differentiation of the Thoroughfares as a Primary streets and a Secondary streets have been submitted as shown on sheet B-9 of the plans. The secondary frontages do not exceed 30% of the total length within the SAP. As proposed, secondary frontages are at 28% of the total length within the SAP. Findings: Consistent 2. Retail Frontage requiring that a Building provide a Commercial Use at sidewalk level along the entire length of the Frontage. The Commercial Use Building shall be no less than seventy percent (70%) glazed in clear glass and provided with an Awning overlapping the sidewalk as generally illustrated in Article 4, Table 6. The first floor should be confined to Retail Use through the depth of the Second Layer. Analysis: Retail frontage is provided at sidewalk level along the entire length of the frontage as depicted in Sheet C-5. More than seventy percent (70%) glazed in clear glass is provided as per Sheet B-6 of the plans. Enhanced architectural permeant elements have been incorporated to provide shade along commercial and pedestrian passageways as illustrated in Sheets D-28, D-29, D-30, D-34, D-35 and D-36. Findings: Consistent 3. Gallery or Arcade Frontage, requiring that a Building provide a permanent cover over the sidewalk, either cantilevered or supported by columns. The Gallery or Arcade Frontage may be combined with a Retail Frontage as shown in Article 4, Table 6. 15-00624ap Miami River SAP Page 5 of 10 Gallery or Arcade Frontage within the First Layer may apply towards Open Space requirements. Analysis: The proposed Miami River SAP includes Galleries and Arcades as shown in sheets D-27 through D-36. Findings: Consistent 4. Build -to -lines that differ from Transect Zone Setback requirement. Analysis: Build -to -lines differ from the Transect Zone setback requirements as depicted in Illustrations 5.6 and 5.10 of the Miami River SAP Regulating Plan. Findings: Consistent 5. A Terminated Vista location, requiring that the Building be provided with architectural articulation of a Type and character that responds to the location. Analysis: The Miami River SAP includes Terminating Vistas and buildings enhanced with architectural articulation that responds to the location and context of the abutting properties as depicted in Sheets B-11, B-27, B-28, D-34, D-33, and D-32. Findings: Consistent 6. A Pedestrian Passage, requiring a minimum ten (10) foot wide pedestrian access be reserved between Buildings. Analysis: A pedestrian passage thirty four feet in width has been provided where ten feet is required as per Sheet L-29. Findings: Consistent 7. A preservation plan acceptable to the Historic and Environmental Preservation Board for any historic resources in the area of the Special Area Plan. Analysis: A certificate to dig has been secured by the applicant pursuant to permit: CTD-2015-45. Findings: Consistent 8. Area Design Guidelines. Analysis: The Applicant has submitted a Regulating Plan that includes Design Guidelines for the Miami River SAP. Findings: Consistent 9. A parking management program that enables shared parking among public and private Uses. 15-00624ap Miami River SAP Page 6 of 10 Analysis: A parking management program that enables shared parking among public and private Uses shall be provided and approved by the Planning and Zoning Department prior to issuance of a vertical building permit. Findings: Consistent, subject to conditions 10. Flexible allocation of development capacity and Height, excluding Density on individual sites within the Special Area Plan shall be allowed so long as the capacity or Height distribution does not result in development that is out of Scale or character with the surrounding area, and provides for appropriate transitions. Analysis: The proposed development capacity and Height distribution is found not to be out of Scale or character with the surrounding area, and provides for appropriate transitions. Findings: Consistent The following is a review of the request pursuant to the criteria under Article 7 and Section 7.1.2.8 of Miami 21. The Background section of this report is hereby incorporated into the analysis and its corresponding criteria by reference: Criteria: For rezoning: A change may be made only to the next intensity Transect Zone or by a Special Area Plan, and in a manner which maintains the goals of the Miami 21 Code to preserve Neighborhoods and to provide proper transitions in intensity and scale. Finding: In determining the appropriateness of the proposed "Miami River Special Area Plan (SAP)", the Planning Department reviewed this proposal and found that it maintains the goals of Miami 21 and provides a proper transition in intensity and scale to the adjacent neighborhoods. G. CONCLUSION: The Department of Planning and Zoning recommends approval of the request for a change of zoning to the Miami River Special Area Plan. The Department finds the request to be compatible with the density and intensity of the adjacent Transect Zones. This project as presented is deemed critically important to the economic revitalization and enhancement of the Miami River area, and consequently a positive impact to the City in general, creating recurring and nonrecurring financial benefits. Staff finds the proposed SAP is consistent with the goals of the Miami 21 as the request is compatible with the surrounding zoning district and provides an appropriate zoning transition. H. RECOMMENDATION: Based on analysis and findings, the Planning Department recommends Approval of the "Miami River" SAP with the following conditions: 15-00624ap Miami River SAP Page 7 of 10 1) The development shall be substantially in accordance with the plans entitled "Miami River SAP as prepared by Kobi Karp, Roman and Williams, Kimley Horn, Raymond Jungles, and Coastal Systems International, consisting of 156 pages dated stamped received by Hearing Boards, April 28, 2015. 2) The applicant shall comply with the requirements of all applicable departments/agencies as part of the City of Miami building permit submittal process. 3) The applicant shall meet all applicable building codes, land development regulations, ordinances, and other laws and pay all applicable fees due prior to the issuance of any building permit. 4) Allow the Miami Police Department to conduct a security survey, at the Department's discretion, and to make recommendations concerning security measures and systems; further submit a report to the Planning Department, prior to commencement of construction, demonstrating how the Police Department recommendations, if any, have been incorporated into the SAP security and construction plans, or demonstrate to the Planning Director why such recommendations are impractical. 5) Obtain approval from, or provide a letter from the Department of Fire -Rescue indicating applicant's coordination with members of the Fire Plan Review Section at the Department of Fire -Rescue in the review of the scope of the SAP, owner responsibility, building development process, and review procedures, as well as specific requirements for fire protection and life safety systems, exiting, vehicular access, and water supply. 6) Obtain approval or provide a letter of assurance from the Department of Solid Waste, that the SAP has addressed all concerns of the said Department prior to obtaining a building permit. 7) Show compliance with the Minority Participation and Employment Plan (including a Contractor / Subcontractor Participation Plan) which shall be submitted to the City prior to the issuance of any building permit. The Applicant shall use its best efforts to follow the provisions of the City's Minority Women Business Affairs and Procurement Program as a guide, as applicable. 8) Record the following in the Public Records of Miami -Dade County, Florida, prior to the issuance of any building permit: a) Declaration of Covenants and Restrictions providing that the ownership, operation and a) maintenance of all Civic and Open Spaces, and any related improvements located thereon, shall be the responsibility the property owner(s), their successor(s), or their designee in perpetuity; and b) Record in the Public Records a Unity of Title or a covenant in lieu of a Unity of Title, if applicable, subject to the review and approval of the City Attorney's Office. 9) Prior to the issuance of a shell permit, provide the Planning Department with a recorded copy of the documents mentioned in condition (6) above. 10) Provide the Planning Department with a temporary construction plan that addresses construction phasing and includes the following elements: a. Temporary construction parking plan, with an enforcement policy; 15-00624ap Miami River SAP Page 8 of 10 b. Construction noise management plan with an enforcement policy; and c. Maintenance plan for the temporary construction site; said plan shall be subject to the review and approval by the Planning Department prior to the issuance of any building permits and shall be enforced during construction activity. All construction activity shall remain in full compliance with the provisions of the submitted construction plan; failure to comply may lead to a suspension or revocation of this SAP. 11) Prior to the issuance of any building permit, the applicant shall provide the Planning and Zoning Department for review and approval: a. Environmental Impact Statement and final reports for the lots included in the SAP site. b. Updated Sufficiency Letter from the City of Miami, Office of Transportation. c. Final determination of Public School Concurrency and Capacity Reservation. d. Conservation Assessment Report (project is located within a high Archeological Probability Zone). e. Proof of compliance with conditions established by the following department or agencies, specifically: • City and County Public Works Departments • Miami -Dade County Water and Sewer • Miami -Dade County Traffic Engineering Division • Florida Department of Transportation (FDOT) 12) The "Miami River SAP" includes a Development Review Process which addresses the build out of the project as identified in the Regulating Plan. All development within this SAP shall be submitted for review and approval by the Planning and Zoning Director prior to the issuance of any building permit consistent with the requirements of Sec. 3.9.1 .g. of Miami 21 and the SAP. 13) If the project is to be developed in phases and/or individual specific projects, the Applicant shall submit an interim plan, including a landscape plan, which addresses design details for the land occupying future phases of this Project in the event that the future phases are not developed, said plan shall include a proposed timetable and shall be subject to review and approval by the Planning Director. 14) The applicant shall meet conditions identified in this Ordinance, with the SAP and all applicable local, state, and federal regulations. 15) Within 90 days of the effective date of this Ordinance, record a certified copy of the Development Agreement specifying that the Development Agreement runs with the land and is binding on the Applicant, its successors, and assigns, jointly or severally. 16) As applicable, CG Miami LLC., as defined in the approved SAP, shall be responsible for securing the City's approval for any change or modification to the approved temporary construction plan. Request for approval of any change or modification to the previously approved temporary construction plan shall be submitted for review and approved no later than two weeks prior to implementation of requested change or modification. 15-00624ap Miami River SAP Page 9 of 10 17) The applicant shall comply with the recommendations pursuant to the Urban Design Review Resolution dated April 15, 2015 attached hereto as Exhibit C. 18) The applicant shall comply with the recommendations pursuant to the correspondence from the Office of Historic Preservation to the Planning and Zoning Department dated May 22, 2015 attached hereto as Exhibit E. 19) The applicant shall comply with the recommendations pursuant to the correspondence from Environmental Resources to the Planning and Zoning Department dated May 22, 2015 attached hereto as Exhibit F. The Applicant shall use its best efforts to follow the provisions of the City's Minority Women Business Affairs and Procurement Program as a guide, as applicable. 8) Record the following in the Public Records of Miami -Dade County, Florida, prior to the issuance of any building permit: a) Declaration of Covenants and Restrictions providing that the ownership, operation and a) maintenance of all Civic and Open Spaces, and any related improvements located thereon, shall be the responsibility the property owner(s), their successor(s), or their designee in perpetuity; and b) Record in the Public Records a Unity of Title or a covenant in lieu of a Unity of Title, if applicable, subject to the review and approval of the City Attorney's Office. 9) Prior to the issuance of a shell permit, provide the Planning Department with a recorded copy of the documents mentioned in condition (6) above. 10) Provide the Planning Department with a temporary construction plan that addresses construction phasing and includes the following elements: a. Temporary construction parking plan, with an enforcement policy; b. Construction noise management plan with an enforcement policy; and c. Maintenance plan for the temporary construction site; said plan shall be subject to the review and approval by the Planning Department prior to the issuance of any building permits and shall be enforced during construction activity. All construction activity shall remain in full compliance with the provisions of the submitted construction plan; failure to comply may lead to a suspension or revocation of this SAP. 11) Prior to the issuance of any building permit, the applicant shall provide the Planning and Zoning Department for review and approval: a. Environmental Impact Statement and final reports for the lots included in the SAP site. b. Updated Sufficiency Letter from the City of Miami, Office of Transportation. c. Final determination of Public School Concurrency and Capacity Reservation. d. Conservation Assessment Report (project is located within a high Archeological Probability Zone). e. Proof of compliance with conditions established by the following department or agencies, specifically: • City and County Public Works Departments • Miami -Dade County Water and Sewer • Miami -Dade County Traffic Engineering Division • Florida Department of Transportation (FDOT) 12) The "Miami River SAP" includes a Development Review Process which addresses the build out of the project as identified in the Regulating Plan. All development within this SAP shall be submitted for review and approval by the Planning and Zoning Director prior to the issuance of any building permit consistent with the requirements of Sec. 3.9.1 .g. of Miami 21 and the SAP. 13) If the project is to be developed in phases and/or individual specific projects, the Applicant shall submit an interim plan, including a landscape plan, which addresses design details for the land occupying future phases of this Project in the event that the future phases are not developed, said plan shall include a proposed timetable and shall be subject to review and approval by the Planning Director. 14) The applicant shall meet conditions identified in this Ordinance, with the SAP and all applicable local, state, and federal regulations. 15) Within 90 days of the effective date of this Ordinance, record a certified copy of the Development Agreement specifying that the Development Agreement runs with the land and is binding on the Applicant, its successors, and assigns, jointly or severally. 16) As applicable, CG Miami LLC., as defined in the approved SAP, shall be responsible for securing the City's approval for any change or modification to the approved temporary construction plan. Request for approval of any change or modification to the previously approved temporary construction plan shall be submitted for review and approved no later than two weeks prior to implementation of requested change or modification. 17) The applicant shall comply with the recommendations pursuant to the Urban Design Review Resolution dated April 15, 2015 attached to Exhibit 1 as Exhibit C. 18) The applicant shall comply with the recommendations pursuant to the correspondence from the Office of Historic Preservation to the Planning and Zoning Department dated May 22, 2015 attached to Exhibit 1 as Exhibit E. 19) The applicant shall comply with the recommendations pursuant to the correspondence from Environmental Resources to the Planning and Zoning Department dated May 22, 2015 attached to Exhibit 1 as Exhibit F. 20) Specimen trees or any other tree determined by the Department of Planning and Zoning to be of substantial value because of its species, size, age, form, and/or historical significance, proposed for removal shall be relocated within the boundaries of the Miami River Special Area Plan and/or Jose Marti Park. The Department shall require a certified arborist to monitor the root pruning and tree relocation preparation efforts on site and to provide documentation certifying that the work was accomplished according to acceptable tree relocation standards and specifications. 21) The applicant shall comply with Section 2-11.15 of the Miami -Dade County Code entitled "Works of Art in Public Places" and Procedure Number: 358 entitled "Art in Public Places (APP) Procedures" for all public improvements such as, but not limited to, Jose Marti Park and the River Walk as applicable.
