HomeMy WebLinkAboutLegislationCity of Miami Legislation Res0[Ution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 15-01217 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DECLARING SURPLUS AND AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED, IN SUBSTANTIALLY THE ATTACHED FORM, CONVEYING TO THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, AT NO COST, FOUR (4) PARCELS, IDENTIFIED AS FOLIO NUMBER(S) 01-0201-010-1120, 01-0201-010-1160, 01-0113-080-3130, AND 01-0113-090-1141, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, TO BE USED FOR TRANSPORTATION PURPOSES IN CONNECTION WITH THE SOUTHWEST 1ST STREET BRIDGE REPLACEMENT PROJECT (STATE ROAD 968); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO EFFECTUATE SUCH CONVEYANCE, WHICH TERMS MAY BE AMENDED BY THE CITY MANAGER AS NEEDED TO MEET THE BEST INTERESTS OF THE CITY OF MIAMI. WHEREAS, the State of Florida Department of Transportation ("FDOT") proposes to re -construct and improve the Southwest 1st Street Bridge (State Road No. 968), Item/Segment No. 424407-1 ("Project"), in Miami -Dade County, Florida; and WHEREAS, it is necessary that certain land now owned by the City of Miami ("City") be acquired by FDOT; and WHEREAS, the aforementioned City -owned land ("Property") currently sits vacant, representing a maintenance cost and liability to the City; and WHEREAS, Section 29-B of the Charter of the City of Miami, Florida allows for the conveyance or disposition of City -owned property in connection with the implementation of projects of any governmental agency or instrumentality without being subject to competitive bidding requirements or fair market value return to the City; and WHEREAS, it is necessary that the Property, currently not needed for City purposes, be conveyed to FDOT to enable the construction and improvements by FDOT of the Project in order to serve the best interests of the general welfare of the City and its inhabitants; and WHEREAS, the Property will be conveyed "AS IS" and "WHERE IS," and the City will not warrant the sufficiency of its title nor any interest it may have in the Property; and WHEREAS, the Property shall be used specifically for the construction, operation, and ongoing maintenance of the Southwest 1st Street Bridge and the adjacent control house, and for no other purpose whatsoever; and WHEREAS, if the Property or any portion thereof ceases to be used for the above -stated purpose, City of Miami Page 1 of 2 File Id: 15-01217 (Version: 1) Printed On: 9/21/2015 File Number: 15-01217 all rights and title to the property, or the disused portion thereof, shall revert to the City automatically; and WHEREAS, FDOT shall relocate the existing storm sewer outfall pipes at FDOT's sole cost and expense, to a location mutually agreed -upon by the parties; until such time that the above -mentioned storm sewer outfall pipes are relocated, the City shall retain a non-exclusive easement to maintain, repair, or otherwise access the storm sewer outfall pipes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as fully set forth in this Section. Section 2. The City Manager is hereby authorized{1} to execute a Quit Claim Deed, in substantially the attached form, conveying to FDOT, at no cost, the Property, identified as Folio number(s) 01-0201- 010-1120, 01-0201-010-1160, 01-0113-080-3130, and 01-0113-090-1141, as more particularly described in Exhibit "A," attached and incorporated, to be used for transportation purposes in connection with the Southwest 1st Street Bridge replacement project (State Road 968), further authorizing the City Manager{1} to execute all documents, in a form acceptable to the City Attorney, as may be necessary to effectuate such conveyance, which terms may be amended by the City Manager as are necessary to meet the best interests of the City. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: Gt f VICTORIA IVIENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
